How badly did I mess up?

Hi everyone,
I came to study in UW in 2017. I studied for one year. Worked part-time during classes and full time during the scheduled break. But due to immense pressure of studies, I took a year off. Also as pure dumb I am, I worked (part time) during the study break. Now I am back to school again. I know, I have made situations really bad but is there any way I can fix things up?

You worked illegally. Also, the school should have reported your absence to IRCC in order for your study permit to be cancelled, so you may now be in Canada illegally and studying illegally. Regardless, with a one year unscheduled break, you won't qualify for PGWP.

As said above, it's quite possible your study permit was canceled when you dropped out for a year - so quite possible you are studying without authorization and no longer have legal status in Canada. That's probably your biggest immediate problem. I'm not sure how you find out if you still have valid status or not. Schools are supposed to report international students who drop out to IRCC which then cancels your visa.

A PGWP requires continuous full time studies. So if you completed part of your studies, dropped out for a year and then continue your studies, you won't qualify for a PGWP.

Probably time to pay for a consult with an experienced immigration lawyer.

I think he can maybe GCMS notes might help there. Or he can ask directly in his school what are their procedures in this case (as there is still chance, that he was not reported).

I am surprised the school let you enrol back without asking for a "new" study permit. Was your part time work atleast cash?

Hi Scylla, No. I talked with my international student adviser. She did mention about the PGWP thing. But when I asked about the study permit having any issues with it, she said that's not a big concern. Please note, it's a very reputed university and I am not lying.

Her response was this "yeah, you are not expected to stay in Canada longer than 120 days (I can't remember the number of days she mentioned) but that's not a problem. The main concern is you have to apply by yourself after your graduation for a PGWP and they might ask for an explanation about your study break. The worst possible outcome is you may get refused for a work permit"

Hi Canuck_in_uk,

I consulted with my international and regular academic advisers before taking a year break. They particularly didn't point out any other issues with my legal status apart from my PGWP thing.

I didn't get my study permit provoked and before enrolling I meet with my advisers again. They didn't say anything about getting a new study permit. Perhaps because I contacted them before taking the break and they let IRCC know that I took a break. And answering to your last question, I am sorry but it wasn't a cash job. I know I should have been more careful but I messed up everything big time.
