Broadly speaking, previous violations of immigration law are "forgiven" by the issue of a COPR.
However, misrepresentation is not, and can result in refusal or revocation at any time.

Refusals could be due to NOC mismatch, PCC or medical.
The issues you mention could also be considered. But don't ever hide if you did something like this (overstay, working other location) - This counts as misrepresentation.

thanks guys, i believe that I am truthful with all my applications all the time. I declare that I overstayed and worked to other locations state from my work permit (it was my employer's fault, =( ) . as a matter of fact, i apply work permit thru work permit support letter but got refused because i declared everything and gave my apologies. I am thinking of reapplying it (the work permit app) but i don't know where to start. My only last option is my PR application which i think it takes a while before the decision will be render. Another thing that I am worrying on my PR app is I only declared cad$4000 on my encumbered amount. I hope this won't affect on my eligibility.

Violating the terms of your work permit are definitely grounds for refusal.

Not your employer´s fault, the work permit is issued to you, not your employer.

Well, if you are talking about work permits instead of EE / PR / CEC, you are posting in the wrong forum - there is a different forum for work permits.

But no one gets a work permit with solely a "work permit support letter." It sounds like (among other things) you did not have a complete application.

Try posting in the worker´s forum.

FYI - IRCC will hold you wholly responsible for any violations since it's your responsibility to understand the terms of your stay in Canada and make sure you maintain legal status. If you are explaining the circumstances of any overstay or unauthorized work in the application, it's not recommended to blame your employer - IRCC doesn't react well to this since they want to see that you have taken full responsibility for your actions (or lack of action).

yeah I know what you mean. of course i didn't blame my employer when i submit my application(referring to work permit application) to cic. I am worrying about is on my pr application that those violations ( my overstay and work location) will have a negative impact. =)

- Hi. I am just put a reference to it. as what I mention, I am worrying that these violations i committed in my WORK PERMIT does have a negative impact on my application on my PR that I submitted a few months ago.

it is possible. And given that your work permit was refused, maybe even likely. You might consider consulting an immigration lawyer, esp. if you are out of status now.

I did have completed my application. =)

OK, so did you have an LMIA? Or, on what other basis were you eligible for a work permit? Did you apply before or after you submitted your eAPR? (Was it a BOWP application?)

I have raised an case specific inquiry.
can anyone suggest me how should i proceed further

Thanks
Can you please share your rejection timeline???

@scylla @zardoz

Hi need your help.

I have made a mistake by requesting my previous employer to write my NOC code on my employment letter. That NOC code 2151 was as per my designation .

Now the thing is my duties match NOC 2251. So my question is if I fill in the right NOC (the corrected one) in express entry profile and mention in LOE that I made a mistake of requesting my employer to write the NOC code based on my designation and request CIC to avoid it as I doesn't match with my duties, do you think it can be any problematic?

I know NOC code wasn't needed on employment letter. But getting letter again from my ex-boss is extremely difficult.

Do you think VO can actually relate that it was a genuine mistake as the NOC code mentioned on employment letter was right as per my designation? Which now I know is wrong way to chose NOC :(

Please suggest if you think LOE will suffice in my case.

Generally, IRCC’s view is to recognize the NOC associated with the actual job functions, rather than the one associated with the job "title". It's probably best to apply based on the functional NOC and explain the document error in a LOE.

Yes.. I got this information for matching duties for correct NOC quite late. But still I have chance of correction so I declined ITA this time. Now I have edited my application with right NOC code.

So for wrong NOC code in employment letter, the LOE can work.. right?
