HI

Can someone point me in the right direction for information as I am getting more confused by the day.

I am Canadian by birth, born in Vancouver, however moved to the UK around 12 years old. I am now 52, married with two children (teenagers), and would love to move back to Canada with my family.

I cant find any information on a returning citizen and what paperwork to fill in, how to go about getting my husband and children over, etc. I just seem to be going around in circles.

The only thing I has established is that I am likely still a citizen as I have never renounced it.

I am also a nurse with 20 years experience if that helps as I know many places are looking for nurses.

Since you were born in Canada (and never renounced citizenship), your children are also Canadian citizens by descent.

You can get them a certificate of citizenship and a Canadian passport - https://www.canada.ca/en/immigration-refugees-citizenship/services/canadian-citizenship/proof-citizenship.html

It's very easy for you and your kids.

For your husband, you'll have to sponsor him via the spousal sponsorship route. You can do this while you live in the UK, but you have to show that you intend to move back to Canada once he gets his PR. This is done by showing that you've looked for jobs, looked for houses etc.

Since you were born in Canada (and never renounced citizenship), your children are also Canadian citizens by descent.

You would apply for a social security number once you have returned to Canada. You don't need a job to apply for one.

You can wait and come to Canada once your husband's application is approved. However in order for his PR to be approved, you will need to show concrete evidence that you will relocate to Canada once he has the PR visa (e.g. property ownership, job offer, assets). This can be quite difficult to do if you have never lived here or haven't lived here in a long time.

Again, as citizens, you and your kids can come back anytime. You don't need to prove anything to anyone, or show that you're going to work, or that you have money or anything at all. You just need to get your Canadian passports via the process outlined in the link I provided.

It's just your husband that needs to be sponsored, and that's not hard as long as you can show that you intend to move here.

Here's what you could do - get your Canadian passport, get your kids Canadian passports. Then, fly here for a visit. Your husband is presumably a citizen of the UK, so he doesn't need a visa, just an ETA. Spend some time here looking for jobs, talking to real estate agents, scouting out schools (depending on how old your kids are).. etc. You and your kids can also get your SIN numbers while you're here.

Having done all this, you can begin the process of sponsoring your husband. You can return to the UK while the sponsorship happens, and you can show your intention to return by telling IRCC about all the things you did as a precursor to moving back.

Would apply for your children’s citizenship now because it can take almost a year. Good full-time nursing jobs with benefits can actually hard to secure. You will also have to look at becoming certified in Canada as a nurse.

I did almost exactly the same as you (moved from Canada at age 12 / 13 and returned with my British wife at age 58!

YOU
You are Canadian, end of story. You don't need to tell anyone in Canada anything in particular. What you will need to do is:

1. Land and tell them you are back for good
2. Complete and hand in lists of stuff you are brining in with you and any stuff that is to follow (shipping). Simple list with approx. values if you sold each item in CAD - two print of each list (so 2 x goods accompanying 2 x goods to follow). CBSA will fill out a form for you and stamp them so the stuff is free of import tax.
3. Go the next day if you like to a Services Canada office with passport etc. and ask the for a SIN (Canada version of NI Number), once you have that you can work anywhere
4. Check out the provincial healthcare and register when appropriate - some provinces have a 3 month wait, others cover you immediately. Again at trip to Services Ontario (or whatever) to sort out.
5. Exchange your UK driving licence for a provincial Canadian licence. This is a straight swap, they will only give you a quick eye test.

YOUR KIDS
Assuming they are YOUR children (i.e. not step children).
1. Apply for Canadian citizenship for all children by descent. Paperwork etc and a fee and will take 6 months or so
2. When that is done, use their citizenship to apply for Canadian passports for all children

YOUR HUSBAND
Apply for outland spousal sponsorship for him to gain permanent residence status. LOTS of paperwork and fees etc. and you will need to prove intent to return to Canada, but it can be done without a lawyer (most people do). Takes about 12 months from sending the paperwork off to gaining approval.
