Has X been working full-time for the employer on their current work permit for at least one year?

Hi,

I got invited and I am filling out the work history part, section intended work in Canada, I answered 'Yes' under valid job offer and this generated many other questions. One of them is "Has X been working full-time for the employer on their current work permit for at least one year? (Or for an equal amount of part time work?)"

The question sounds ambiguous to me. I have a Young Professional permit (LMIA exempt and closed one year work permit) And I have worked for my current employer over a year on 2 different permits. For the current one I worked for my employer for 7 months.

Do I have to work for my employer for at least one year on the current permit, or does the employer just has to be mentioned on my current permit and in general I have to have worked for him at least one year.

I hope you can see where my confusion is coming from. Let me know what you suggest. Can I answer "Yes" and clarify in LOE??

I believe it says have you been working on your "current" work permit.
Question: is this a renewal of the previous work permit ? Are both work permits issued on the same basis/program and the new one is just a renewal ?

Hey, both work permits are part of the international Experience Canada. The first one was an open work permit, called Working Holiday. the second one is a closed work permit, called Young professional. Both visas are a once in a life time opportunity and cannot be renewed. Does that provide more insight?

Are you sure? I asked a native speaker and he said the opposite.. :(
100% sure. Because of the wording elsewhere -

https://www.canada.ca/en/immigration-refugees-citizenship/services/immigrate-canada/express-entry/documents/offer-employment.html

if you have a valid work permit for a NOC 0, A or B job that is exempt from needing an LMIA, and you:
  • are currently working for an employer specified on the work permit
  • have one year of full-time work experience (or an equal amount of part-time work) for that employer
  • have a valid job offer from that employer for at least one year after we issue your permanent resident visa
BTW - also a native speaker : )

Thank you for your reply :)

Just to make sure I understand it correctly. The following scenario would be accepted under arranged employment?
I worked for X from Jan 2018 to Oct 2018 (8 months) and started a new position for the same employer this Feb 2019, where I am still currently working. This should satisfy that then - "...have one year of full-time work experience (or an equal amount of part-time work) for that employer" ??

Thought I already answered this somewhere else.... it does not say that the experience has to be continuous, therefore, no continuity requirement.

That is the best guess based on the guidance provided by IRCC. I assume the reason for the gap was that you were waiting for a new work permit. That can be explained in the letter of employment, shows respect for immigration rules : )

Can you please confirm the answer for the below question.

1. I have been working in Canada for 2 years for an employer and left Canada at Oct 2018.
2. Now, Came in new work (Starts at Dec 19) permit with the same employer for 24 month assignment. I would like to claim job offer points with this assignments for my PR.

The below questions answer is 'NO', I cannot claim job offer points if the below answer is "NO". Can you please confirm, just to make sure, I am not doing anything wrong.

Has XX been working full-time for the employer on their current work permit for at least one year?
--NO

For starters, what kind of work permit do you have? Different types of permits have different requirements, this requirement only applies to LMIA-exempt closed work permits.

Since the original thread, IRCC has clarified that they want one year of continuous employment for this. Because you left Canada and there was a gap between your first and second periods of employment, for the purpose of this question, you have only been working for this employer since Dec 19, 2019, so the correct answer is No.

I have been working for the same company for 1 year and a half for the same company however the first 6 months were a third party employer work permit ( recruitment for my current company) does it count for a full time one year, while is mentioning the work permit? It can be a stupid question, but I feel I made a mistake when I received my ITA 11 months and 20 days previous turning to a year for the employer mentioned in my work permit. could someone with similar experience give me an insight about this? should I decline my ITA?
