Same-sex common-law partner affecting student visa

Hi everyone

I am a gay man from Iran who has admission from a canadian university. I have a question that if I include my common-law partner for open work permit in my application , what are the chances that our visas get rejected? Does the immigration officer reject us because we are gay and in our country gay activities are prohibited and even dangerous ? I mean, would he automatically assume that we are trying to escape our country and stay in canada because gays are discriminated and even threatened in our country ?

And is it better that I mention him in my application but apply for his visa later after my visa gets approved ?

I should mention that me and my partner are living with each other since more than one year ago.

As long as you can prove that you have lived together for at least one full year and meet the common law requirements, there won't be an issue in Canada accepting your partner or relationship. Gay relationships are perfectly normal here. Whether your visa and his visa are approved is a different matter. To be approved, you want to demonstrate strong ties to your home country and prove you have no plans on remaining in Canada long term. This is standard for anyone applying and is a common refusal reason.

Not sure if you are aware but spouses and common law partners of international students are not guaranteed visas. You must declare your partner on your application or you will never be able to sponsor him. If he gets denied for an SOWP he can apply to join you when you have PGWP, a job in NOC 0, A or B and 3 pay stubs. As @scylla mentioned, it is really important to keep documentation during the period where you have been living together.

We have many documents to support our common-law claim , like joint rental and official documents which show the same address for both of us and also joint bank account and ...
Now I want to know if including him in my application will affect my own visa or not . I mean is it a chance my visa will be rejected as well as him just because I have included him?

Who knows not because you are gay. If they feel like you are not a genuine student and are seeking immigration or asylum certainly it can influence. The issue is you really don’t have a choice and must declare him.
