Hello,

We have moved to Canada through my husband company job transfer. We are here on a Work Permit through our company.

I believe since this is an ICT WP, we are on an LMIA Exempt job.

We are keen to apply for the PR and his company has offered a full-time permanent job for him.

With this , can we claim 50 points for Job offer since his job is LMIA exempt?
Secondly job letter from our company is sufficient?

Please advice

Yes you can provided you can get a letter from your company showing you will have work in Canada for 1 year after getting PR

Since it is LMIA-exempt and ICT, your husband would have to work for a full year (52 weeks) in Canada before being able to claim the arranged employment points. It would then also make him eligible to apply under the CEC class.

Secondly job letter from our company is sufficient?
You would need two different letters from your company.
One, for all work experience claimed for points, a reference letter is required attesting to the work experience already gained.

Second, to meet the requirements of having a valid job offer, your husband would have to have the offer of permanent employment (after obtaining PR status) as a written job offer.

Yes, both letters can be combined into one, as long as both sets of information requirements are met, but then you upload the same letter twice. Sometimes it is just easier to get two different letters (depending on the employer), just to be sure.

I was not aware about this one year experience need, if this is required then we have to wait till next year. He came early march and we joined in May. We were waiting for the paperwork to complete and we just got all the paper work done. Is it better for us to put ourselves in EE profile or wait for one year completion?

The one year is absolutely required to claim the job offer points. The only way around this is if the employer obtains an approved LMIA.

You can enter the EE pool now. However he won't be able to claim the job offer points until May 2020 (unless the employer gets the LMIA).

Hello,

I have a question on the same topic, if someone could please answer it I would really appreciate.

I will initiate my PR Application under the CEC Category in November 2019 as I would complete 1 year of employment on a Work Permit (LMIA Exempt) in Canada.

Below is my question

Given that I will have 1 year of work experience in Canada (in November 2019) I will be eligible to claim the Canada Work Experience points. Would I also be able to claim points for the Job Offer if my employer provides an Offer of Permanent Employment after obtaining PR?

So is it, Canada Work Experience Points + Job Offer Points?

Thanks and sorry for the delay in my response. Since we have to wait for a year, we have to take steps little bit easier now.

We were checking with my husband employer on what how they can support.

My husband verified with their HR and it seems the company does not give any custom letters for filing PR not they formally sponsor for PR filing and they advised we have to file this ourselves. They issue a standard letter indicating the the job is permanent which start date (both date of hiring in Canada and when he started working with company), salary details along with job location. It seems it also indicates that he has a 40/hr per week job and with authorized signatory.

Will this be sufficient or do we need any additional letters or details as supporting documents. Since company formally does not this file, obviously we may not get any company related documents, however we will have payslips, tax documents and offer letters, etc.. we will also have residence proof for our stay in Canada.

Pls. advise.

I have seen my friends claim job offer using assignment letter/ deputation letter or support letter issue by the company.

If your husband is working in Indian based IT firm he should have one of such letters, this can be used only if work permit is valid and letter is valid atleast for year and half after you apply for PR

Example let’s say your husband completes a year in Canada by December 2019 and you apply PR on same month , his assignment letter/deputation letter should state he will be deputed in Canada till June/July 2021 and ideally work permit should also be valid for this period.

Point is you have to prove your husband has work in Canada for one year after PR is approved, why the letter should be valid for year and half after application is because normal PR processing time is 6 months.

Do I need to have start date in letter and can it be future dated say joining from 1 April 2020 ( factoring 2 months of PNP processing and 6 months of PR processing) ?

Instead of guessing a start date, better to state, "upon obtaining permanent resident status."

Also any CIC link which confirms that 50 points be claimed in such cases ?

The key to getting the 50 points is having them state you have a job offer for 1 year after you get PR in Canada. For your your current WP ends in August 2020, so I think you should try and get somone to attest to the fact you will have a job after that, and they won't just ditch you after you initial agreed secondment is over.

Other than that everything you have meets the job requirements. Do you have a LMIA? or are you in a LMIA exempt position? You will need to provide evidence of one of these too.
