Hi, my partner is in Canada with PR status. We are in a same sex relationship. We are already a couple for 2 yrs and a half before she migrated in canada last 2012. We continued the relationship until now. She supported me financially since 2012 up to present(i have kept remittance slips, i have a lot). We have maintained a joint bank account since 2015 up to present. She visited me once 2015 and was not able to visit me eversince as she was super sick early 2016 with a lot of complication , went thru 2 surgeries 2018 and was unemployed. Now, she's getting better, shes on her 1st year with her permanent full time job. Scheduled to visit me feb 2020. We are planning to submitted our supposed application (supposed to be submitted after her visit last 2015) but did not push thru as she got sick. Now, we are planning to go about it and submit it october of this year. Do we qualify under conjugal category? Do you have any suggestions or tips for me? We really want to be each other so bad. By the way, i am living in the Philippines. Both of us are Filipinos.

Have you tried to apply for a TRV? A refusal will be necessary for a conjugal application. Not clear when she started working full-time again but she should certainly needs to show that she is back to being capable to work again. There will definitely be concerns about you visiting so few times.

Hi, thanks for responding. She is getting well and is working for already a year with her permanent full time work with Alberta Health services. Can she include medical certificates to prove the claim she wasnt able to visit me more often because she got really sick? As for ma? I have not yet tried applying TRV as i could not supply its requirements. Is it practical to still apply TRV now just to prove I will be denied anyway? Thanks for your help.

Yes, you will have to prove that there is no way for you to come to Canada to apply for common law. The best way to do that is by applying for a TRV.

Okay, will that be not an issue if we will submit our application by October or November this year and I only tried applying TRV mo ths prior the application? Thanks.

Being back to work for a year is good proof that she will be able to provide for her family.

Hi, yes, we were already a couple before she migrated in canada but we were not able to live together while she was still in the Philippines since we were still studying. We started young. The relationship matured as time passed by the sad part is we are already far from each other. She supported me financially since she migrated in canada (2012) up to present and i have kept all remmitance slips (i have a lot) alread. Also, we have opened a joint account when she visited me last 2015. I already have 3 bank certificates to prove our joint bank account. We were supposed to submit our application after her visit but early 2016 she got really sick, had complications had 2 surgeries and didnt have a stable job thats why she wasnt able to visit me. But thank God, shes doing great now, landed a permanent full time job and on its 1year working. She is set to visit me feb 2020. She is getting a house of her own to prepare for my arrival (hopefully) ...
