A brother with a intellectual disability

I have a brother he is 26 and intellectually disable and fully dependent on my parents whom are living in Sudan but they all want to move to Canada for a better life for him and to put him on a center or so to get better chances in life and healthier environment with his condition and his older sister is a Canadian citizen living their for years their with her family so what’s the best way they can all move their and my parents are of a good funicular status .

You would have to try to sponsor your parents through PGP. The problem is that you brother will likely not pass the excessive medical demand test so the PGP applications would be refused. The wait time to get your child into a group home is over 25 years so your parents or you will likely be responsible for caring for your brother for his lifetime. Most day programs end at age 21.

You would have to sponsor them through PGP and your brother would have to pass the medical. He would likely not pass the medical. Even if you have money there are no spots in group homes so your family will have to be prepared to care for your brother at home. You can research the lack of services for intellectually disabled and autistic adults.

Not likely. He will have to pass a medical exam before he can move to Canada whether you say you will pay for his health care or not. The rules are the same no matter what - he MUST pass the medical before he would be given a visa to live in Canada.

Most healthcare services in Canada are publicly funded and offer no private alternatives.

But what you're not really hearing regarding what the previous poster said is that you will likely NOT be able to immigrate to Canada because of the medical conditions of your brother. The only time the government exempts anyone from passing the medical exam is if they seek asylum. In this case, due to their refugee status, Canada doesn't reject their refugee application as per international humanitarian law. But that is not the case for you guys. Perhaps you can look into another country to immigrate to.

Yes - this can result in him failing the medical. It all depends on how IRCC assess the level and cost of the care he requires.

Sorry for bothering again but from what I have known that the law had changed and that there is no regulations against children or adult with mental or physical disabilities that stop them from living or visiting Canada .

The law changed to increase the Excessive Demand Threshold but it still exists.

They do not regulate against people with mental or physical disabilities from living or visiting Canada.

BUT for being a dependent or an applicant of a family sponsorhip application (non-spousal), everyonne needs to go through medical exams and to ensure that they will not require excessive medical once they become PR.

If your brother needs physical help, that's medical (including day to day care-aid cost). If he doesn't and is just not smart enough to find a job, then he doesn't qualify as an "adult" dependent of your parents.

The cost of his potential care like in a group home or disability payments would likely go over the 100K in 5 years. Even if you say you have the funds to pay for things as a family, you can access the public programs as a PR so there is no way to insist that you pay for things privately. You can certainly try to get a spot for PGP, if you meet the requirements, and see what happens.
