My wife and I met in 2016 and I are looking to move to Canada to live and to work and submit our Spousal Sponsorship application this month. We are living and working overseas and are planning on having a wedding celebration in Paris, France with family by March 2020 when we can all meet. Are we still allowed to submit our wedding photos 9 months after the Spousal Sponsorship application has been started? Or would this be a better thing to bring these photos in for an interview meeting? We expect the application to take approximately 1 year in processing, so June or July of 2020 to receive an answer of some sort.

Also, can the outland sponsorship application be sent in electronically or does it need to be mailed in to IRCC?

Thank you

the application has to be sent via mail... the checklist states that photos are needed as proof.. it would be good to have photos of your wedding.. but unless they ask for something specifically, you shouldnt send it afterwards.. they require up to 20 photos at the time of submission. an interview is NOT guarenteed so no one can say if they are needed.

are you a citizen? if not, you cannot apply to sponsor your spouse while living outside of canada. please note that she will not be able to work in canada without a valid work permit, which should be submitted with the spousal sponsorship application

i suggest you take a look at least at the check list as well as the guide to help make some decisions

Better submit as soon as possible as it will add +ve effect on the VO so interview could be possibly waived too! Taking it with you at the interview when they have already have Qs? Not a good idea. Submit it thru webform

Yes I am a Canadian citizen, born and raised, but in 2015 I moved overseas for work and this is where I met my wife in 2016. Regarding my status, I am not currently paying MSP, as I am not a resident of Canada. That has all been sorted out with Canada Revenue Services and I am in good standing with CRA and don’t owe any money but will this put any hold up on sponsoring my wife and am I still eligible? I see Canadian Citizen being the requirement, which I am, but just making sure as I have not lived in Canada for the past few years other than visiting family for a few weeks on holidays. And now that I’m married we both plan on moving to Canada to live and to work.

We are looking to submit our sponsorship application as soon as possible but how is my wife able to get a valid work permit a year in advance? Sorry for the silly question but is a work permit issued through government and work visa issued through a company? If so, how is a regular work permit different from an Open Work Permit?

she has to physically be in canada to apply for it... depending on where she is, she will need an ETA or a valid tourist visa to enter canada... once here you can submit the application for PR and OWP... you can apply overseas as outland and wait until she received her PR and continue to work where you are but will have to prove your intent to return

You are able as a citizen to sponsor your wife for PR but be prepared to demonstrate that you will return to Canada once she's been approved. If you don't have photos from your wedding just write a letter explaining that and try to provide photos of your relationship over time especially with friends and family to dispel any notion that the relationship is not valid.

Work permit does not apply in your case.

Thanks for the helpful reply,

She is an Algerian citizen so eTA is out of the picture. So valid tourist visa it is. But that only lasts 6 months? Does she still need this if she receives approval for the Outland Spousal Sponsorship?

Another user here let me know that OWP is not available for those applying under Outland Spousal Sponsorships, even after sponsorship approval and entering Canada.

A bit confused on this, if we land in Canada immediately after Outland Sponsorship has been approved but before the start of the 3 year PR has been processed will my wife need to go return flight and come back to remain in Canada?

Thanks

Honestly, she has little chance of a TRV being approved. You can still try but with a Canadian spouse, chances are very low.

If you are not planning to come to Canada until the PR app is approved, she doesn't need a TRV.

"3 year PR"? No idea what you are talking about. Once the outland app is approved, she comes to Canada and lands as a PR.

Oh that last bit is awesome news. Out of curiosity how long does the PR last for, is it still 5 years or around that for those getting it through spousal applications? And can she work with a PR or will she need to apply for something additional after spousal sponsorship approval and landing in Canada with PR in order to work?

I think what I mean is 3 years living in Canada as PR to become a Canadian Citizen and receive a Canadian passport.

Next I will research if we are eligible to land in Montreal, as I am non Quebec. I understand a Selection Certificate is needed from Quebec but not sure if it’s need before we mail our spousal sponsorship application in? Off to those forums to ask.

Thanks again helping with it all.
