Apply 'In Canada' or 'Outside Canada'???

Hi,

I have a enquiry regarding my weird situation in applying for my study permit, I have been living in Canada for around three and a half years now on a IEC visa then a two year work permit. A few weeks ago I had to leave Canada and return back to the UK for a family emergency, I have since had to leave my job because I will have to stay in the UK until the start of my college course in September.

I got my college acceptance letter through a few days ago and am now confused as to which path to take on the 'Come to Canada tool'. I understand that I am not physically in Canada anymore and to my mind that would mean I should apply as if I am 'Outside Canada', however, when it comes to the question 'Where do you currently reside?' my answer must be Canada because that is where I live at the moment. My life is in Canada, address, belongings, money in my bank, credit cards, etc. I am just visiting the UK for a few months.

I did find out on the CIC website that even though I had to leave my job, my permit is still valid until the expiry date as I was hoping to go back and continue working for my employer, which now I can't do, but it does allow me to re-enter Canada on this permit.

Has anyone had any experience with this? I have scrolled through hundreds of pages trying to find an answer with no luck, I am basically a little worried that if I select 'Outside Canada' as an option my work permit will flag up and my application will get refused and I will have to redo it. My course starts on 3rd September so i do have some time however I would rather do it right the first time.

I can't tell you what the right answer is sorry, maybe someone else can help you with that. However I can tell you I applied through the London office and I have been waiting 17 weeks so far, my application is taking longer than average because my history is a bit more complicated, as is yours. So if at all possible maybe applying through the Canadian Office is the best option if you are able to.

If you can currently legally enter Canada, then you can go to Canada and then apply.

If that's not possible, then you will have to file it from the UK.

That makes sense in my head, I would have to be physically in Canada for me to apply from there right?

Yes, that is correct. You would have to have status and be physically present in Canada to apply "in Canada". You can certainly use your Canadian bank accounts as proof, and your past visits to Canada, along with you respecting the terms of your visa should give you an advantage. However, those things don't let you use the "in Canada" application option.

Thank you so much for clearing that up, I just needed reassurance as I suppose I already knew the answer. Really appreciate the help!!
