EE Profile Reject - Currently on open WP

Dear experts,

Here is a summary of my situation, and my query is at the end of the summary:

  1. My wife and I are currently in Canada. My wife is on an LMIA exempt WP (Intra company transfer) since Jan 2019, and I am on an open WP. The WPs were originally valid through Aug 2019 and are currently in process for a 3 year extension
  2. Since my wife has not completed 1 year in Canada on the LMIA exempt WP, we cannot apply with her as a primary applicant as yet. Based on what I've researched, we can do so only after 1 year to claim points for her job offer as well as time spent working in Canada.
  3. In the interim, I tried to create a profile with me as primary applicant (no job offer in Canada yet) as I had better scores on my IELTS and ECA and the overall CRS was around 450.
  4. In the EE profile creation, I answered 'Ýes' to 'Have you applied to IRCC earlier', as I do have a valid WP with a UCI number. I went on to fill out the other details and submit the profile, but it got rejected soon after submission.
  5. I then tried to create an identical shadow profile (which I subsequently deleted), with all details identical to the profile created in pt 4 above, only difference was I responded 'No' to 'Have you applied to IRCC earlier'. This time the profile creation was successful.
My query is - does having a current WP make one ineligible to apply in EE? I had read somewhere that it is possible to apply for EE while on a WP. Experts please help!

No it does not make you ineligible. Those on open work permits can certainly apply.

Any clue on why the profile is getting created when I respond 'No' to 'have you applied to IRCC', and getting rejected if I respond Yes and provide my UCI number. It seems baffling, as all other details I've filled are exactly the same in both profiles, down to the ECA and score details.

Should I respond Yes or No to 'have you applied to IRCC before', considering the open WP which I have was applied by my spouse's employer and not me directly? That might seemingly solve the problem. Please advise.

What you answered for "Did you apply for Express Entry before?" ?
