Hi

1. No ban.
2. It is quite likely that if you apply for a TRV the overseas office will probably think you will overstay your status or have your spouse sponsor you in Canada, so will refuse,
So, what about if I apply for spousal sponsorship PR since my wife and children are PR in Canada?
Can i do my application immidiatly after i leave Canada?

Hi Leon
I have got removal order (deprture) for non compliance with PR obligations,is there any type of bane follow this kind of removal?

Do you think i will be considered inadmissable and i will not be eligiable to apply for vist visa to visit my PR family?
Hazar when were you issued the departure order? On entry to Canada you will have had a right to appeal the order through the immigration appeal division, but there is a time limit to do so - you should have been provided information at the port of entry about this. If you do not appeal you must confirm your departure from Canada in 30 days from receipt of the removal order being issued or the order will become a deportation order which is a lifetime ban on return without minister's consent to return - you also are no longer a PR of Canada at the end of the appeal period. You would be entitled to a pre-removal risk assessment if you do not depart Canada prior to the order becoming a deportation order. In the case of the order becoming a deportation order and a negative PRRA you would be inadmissible to Canada for life if not approved for authority to return to Canada and therefore no Visitor visa again. if you do not appeal the order, or depart within the 30 day time limit following a negative decision at appeal you do not require permission to return if no visitor visa is required, but will need a visa without ARC from anywhere else. You are certainly advised to seek advice about this in person from a reputable source who can look at all the facts of your case and advise you appropriately. Time is of the essence.

Deportation = You are in some country, you either overstay your visa or commit a crime and as a result, you are deported, that means they make you leave this country. Probably would be followed up with some type of ban to re-enter this country, for a couple of years or forever depending on what you did.

Inadmissibility = You apply for a temporary visa or a PR for some country but they don't want to let you in, for example because you have committed a crime in the past. That means you are inadmissible. In some cases if that is the situation, you can fix it by getting a pardon for your crime.

I was banned three years ago because of the misrepresentation done by my education agent in my student visa file and my husband is in Canada he has applied for a post study work permit, how can i get pardon on that? And if I am banned, does it affect the status of my husband who was prior in Canada before my ban, we got married last year.

You cannot get a "pardon" for misrepresentation. You can only apply after the five years have expired.

The ban will not affect your husband who was there before you.

You cannot get a pardon. You have to wait till your ban is completed (5 years? so two more years).

This will not affect the status of your husband, he just can't sponsor you while you're inadmissible.

No, you can't apply for anything for five years in Canada. a TRP is for exceptional circumstances, which I doubt you have.

You can apply to USA or Europe, but you must not lie about your Canada ban when they ask you.

Getting a TRP is extremely difficult. You'd have to have a very good reason (like a critically ill parent in Canada that you want to see). You won't get it for just any reason.

You can apply to some other country, but how does that help you get to Canada? And yes, your ban will affect visa applications to any developed country for the rest of your life. Unless you get a different citizenship. Over time it will affect you less, but that's at least 5-10 years away.

What are the chances of getting a visa to canada after the completion of my ban, if my husband sponsors me? And how can i determine the exact time of completion of my ban?

If your husband is a PR/citizen when your ban expires, then your chances of getting PR are reasonably high. If he's there on a temporary work permit, it's hard to say.

You should have received a letter when you got banned. Most misrepresentation bans are for five years, though some may be longer.
