New York State Police Certificate Requested - Help!

Hi, I am wondering if someone can help me? I got an email from CIC stating they need:

> Police Certificate: We acknowledge the receipt of FBI certificate. Please provide state level Police certificates for New York and any state that you have resided in for 6 months or more. This must be received at this office by: 2019/06/27
> Biometrics: We sent you Biometric Instruction Letter separately on 2019/05/22. Please complete and provide proof of completion of Biometrics. This must be received at this office by: 2019/06/27

In order to continue processing your application we require the documentation identified above.

I never got any request for a police certificate before this. The soonest I was able to get a biometric appointment was June 10th. What the heck is a state level police certificate and how do I get one for NY? That's the only state I've lived in. And how do I submit proof of completion of Biometrics? Do I get given something from USCIS after the appointment?

I am freaking out and have no idea what to do.

I did and I saw that. But is Record Review the same as a State Police Certificate? If so, it mentions two types of records: Suppressed and Unsuppressed. Which is CIC looking for?
Assuming you have absolutely no criminal history, you should get the Unsuppressed one. Why get the suppressed one if you know there's nothing to be suppressed?

I had a case that was dismissed and sealed from 2005. Unfortunately my younger brother first started suffering from mental illness at 15 years old and attacked me when our father and step-mother were not home (ironically at their cottage in Canada) and I defended myself by hitting him once. He then walked to a police station 5 streets away, claiming I assaulted him and the police arrested me because he came in (even though they didn't want to do it). I was detained for 15 minutes and then a call to a judge was made who thought the whole thing was ridiculous and let me go. A month later the court date happened where the DA and judge went at my brother for wasting police time over fighting with a sibling. They dismissed and sealed the case right there. It took a long time for me to forgive my brother. He was even a groomsmen in our wedding. Unfortunately to this day he still suffers with mental illness. My career is spent working in the medical field, particularly at a state mental health facility working. I did answer honestly if I ever was arrested and detained and briefly told what happened. I also included the sealed Town Court Certificate of Disposition where it doesn't disclose the charge and states it cannot be displayed due to being dismissed and sealed. I answered yes to being arrested at my Nexus interview and explained what happened. My FBI certificate came up no criminal history.

Personal Record Review – Unsuppressed

This response contains all criminal history records, including those suppressed or sealed under New York State Criminal Procedure Law (CPL), including:

  • CPL 160.50 dismissed cases
  • CPL 160.55 eligible violation/infraction convictions
  • CPL 160.58 eligible substance abuse and related convictions
  • CPL 160.59 eligible convictions granted by the court
  • CPL 720.35 youthful offender adjudications
  • Individual charges dismissed in court and the equivalent arrest charges, if the case was disposed on or after Nov. 1, 1991.
Personal Record Review – Suppressed

This response does not include sealed or suppressed information, as detailed above.

So with I said above, should I still get the Unsuppressed one, or should I contact CIC and ask? Though I doubt a call rep is going to know what to say to me as they are not a reviewing officer. Working at the mental health facility I work for I underwent CPS and criminal background checks, fingerprinting and urine testing and I was hired. I never had a problem working at any healthcare facility but the mental health hospital was the most I ever went though for a position.

Oh and a record review is the same as a state police certificate?

Ah, this is probably why you were asked for the NY state PCC.

Since you have already explained the circumstances in your application, I believe that you should get the unsuppressed one. It's likely that IRCC wants to see if your explanation matches what's in your history. If you send them the suppressed report (you already sent them the Town Court certificate, they obviously want more), which won't have the record of the case that you've already told them about.. they may not accept that.

Yes, the record review is the same as a state police certificate based on how I read it. You can go to your local police station and ask them to be absolutely sure.

People make mistakes and my brother as an adult regrets what he did especially when my husband and I fell in love but he was in a bad place at the time of the incident. It's already hard being a teenager, much less one with mental health issues forming. This was always something I feared in the back of my mind to prevent me being with my husband even though it was dismissed and sealed and so long ago. I always believe honesty is the best policy, I don't have anything to hide, also did not want a 5 year ban. I just am so unfamiliar with this, much less two different kinds, as I didn't understand if they were looking for a "clean" record like the FBI certificate showed because obviously the Unsuppressed will show the 2005 case. Your explanation does much sense. That they just want to see it matches.

I did not know they were the same thing. I was very confused.

@21Goose I really appreciate your kindness and helping me with advice and information in this matter. I am just terrified of not being able to be with my husband because of what happened, also a fear of a file transfer to LA because I heard US applicants with a criminal history can get transferred there and take forever (even though under NY law the state does not consider me to have a criminal history especially since the case is dismissed and sealed), but Canada could see it differently.

I don't think you should worry. Your case was dismissed - you are not inadmissible as you were found innocent.

I mean, a random person could accuse me of murder tomorrow, and I could be arrested by the police. Just because I'm arrested doesn't mean that Canada will instantly deport me. If I am exonerated and the case is dismissed, I do not have a criminal record.

You absolutely did the right thing by informing them about your history. If you hadn't, and they found out on their own, you would most definitely have been barred.

Thank you for giving an example such as what you mentioned. I talked to the criminal division place in Albany this morning and they told me to get the unsuppressed report because Canada just wants to make sure that was the only thing that happened and nothing since then. I made an appt for Friday morning in the Falls and it will cost $62. There are 4 locations in WNY but that's the only place for Friday. I was told that if it's done on Friday Albany gets the request on Friday but they won't start processing it until Monday and that it can take up to 7 to 10 business days but if I expedite it by calling UPS or FedEx and creating an account in which they will bill when its shipped out, and it can take just 1 or 2 business days so that's what I'll have to do even if it will cost more money like $50-$60 but I'm limited with time so I have no option. I called UPS and made an account, and then after the appointment and if my fingerprints are good, I can call Albany and let them know my account number and they'll expedite the process. And I called the finger printing place (Identogo) and I explained my situation with my finger prints in the past even with the FBI check (because of working in healthcare and being a grad student, my finger prints are pretty non-existent) so they said within 5 minutes they generally can see if the prints are good and then they said if they're bad than I can retake the same day. So hopefully this post will help someone else out. Thank you again for being so kind and helpful. I truly would have been a wreck and at a complete loss without your direction @21Goose . So much gratitude and thanks to you.

Thank you again. I was told misinformation Wednesday. I called them after my appointment today but was told I have to call Albany next Tuesday to see if my request was processed or not due to my fingerprint situation. The lady had a hard time taking them which I expected. So in limbo until then. But thank you again. As long as my fingerprints can go through for this state certificate and biometrics I'll be less worried. Thank you again!
