Applications should not be subject to unnecessary delays. A delay that cannot be justified is a denial of procedural fairness.




So does this not apply to our cases then?
It applies, but only if they accept that the delay is unnecessary. But they would never accept it i am sure. They still inform us that our file is actively being processed.

Since 13 months they are unable to determine if my application meets eligibility requirements or not.

It does technically apply to all applications. But it is just letter of the law not being executed properly. Also, we are so small of a number that it does not get highlighted badly on their performance either. We will get through this guys. All you can do is stay strong and wait for your turn.

Do you know how long your file has been there?
Have you called them regarding progress?
I think it moved there with a whole bunch of other files at the end of March - the only reason I really know it's moved is that my office got a call from the High Commission in Pretoria in the first week of April to confirm my employment, so they obviously have the file open at last. I haven't called to confirm - have just resigned myself to more waiting. According to our representative, it's a good thing that the file has moved and she's positive we will finally have an outcome soon.

Today we are two days short of waiting 400 days. Feel super depressed today. I really don't understand how some people can get their visa in two months and then we all sit here waiting for over a year, as if our files are just sitting gathering dust.

I feel you, it's very depressing. I'm also passed 13 months and no news whatsoever.

I feel you, it's very depressing. I'm also passed 13 months and no news whatsoever.
I ordered my GCMS notes last month and got them day before yesterday and forwarded it to my Lawyers yesterday. The feedback I got was that my file basically has been sitting idle since the last 9 months after I got a request for RCMP fingerprints last July 2018. Waiting to be reviewed by someone.

Legally IRCC cannot keep an applicant waiting with undue delay. IRCC is doing so. There is no security screening started on my profile. Neither has there been any more ADR required. It had actually just been sitting without any delays and this information is coming from a Lawyer seeing the GCMS notes and not me personally.

I am beyond livid!!! 13 months of our lives gone just like that. It is true that due to this reason I have all the right as a CEC applicant to file a case against IRCC to the tribunal branch court. But my lawyer also warned me that it might just open a flood gate for all waiting applicants legally against IRCC.

The Federal elections are coming soon. I wonder if the Liberal parties can handle another negative news like this after the SNC Lavalin case that is going on against them if now a news that them, the Liberal Party who is all for immigration, is actually keeping applicants waiting for so many months and not meeting the laws set by the government where a visa officer can not unduly delay an application by making them sit.

I have a good mind to go to CBC with this information!

I am 100% sure that all the applicants waiting so far are in the exact same boat as mine(Unless they actually are in security screening).

I am Outland applicant, but I am sure even my file must be just collecting dust. Due to this delay I messed up a lot of things. Now I decided that I should not wait for the decision and continue with my plans. Because as much as I am waiting for it, seems like its getting delayed even more.

The shocking thing is IRCC still replies saying "ur file is ACTIVELY being processed". Either their definition of actively is different or the meaning of actively should be changed in dictionary.

I am with you except I had RCMP in April just after a week from AOR. I, too, am CEC applicant and a lot has been put on hold because of this. I just don't know how they are getting away just by saying your application is in a queue for officer to review for past 8 months. There is no accountability from IRCC side. This is just becoming ridicules and shit show for individuals like us, if you ask me.
You are not alone though. Keep your head up.

As far as I have understood from all of this, the IRCC agents(Phone or CSE) will never say that a file is unduly being delayed as it is a direct break of rules set by IRCC themselves. Even if the file is not being processed they will continue to say that something is going on as in turn that would mean that the file is not being delayed and that something is actually going on even though its not(which breaks the rule). They took in more applications and this in turn proved too much for them to handle and thus started to procrastinate and couldn't handle more than they could chew!

From the beginning of an application, if a junior agent who assess a file finds nothing wrong with the file and no RR then they just pass it for a senior officer to verify and eventually it gets passed which in turn leads to the early approval for so many candidates.

However if the junior officer(god bless their lack of experience) cant understand something then they flag it as RR and by all means if it ends up in a hell hole like Sydney, Nova scotia then thats it! It sits there collecting dust until an officer has mercy to take a look at it finally!!

The biggest irony is when IRCC sends an ADR to an applicant they give a timeframe of 30 days to respond back and threatens basically that if the response in not met within the said timeline then the file is deemed discqualified/ could be rejected. However when their own laws mention that no file should be delayed unduly then they try every possible way to conceal that fact so that they would not have to answer to anyone then.

I am just mentally tired so much now!

I am with you except I had RCMP in April just after a week from AOR. I, too, am CEC applicant and a lot has been put on hold because of this. I just don't know how they are getting away just by saying your application is in a queue for officer to review for past 8 months. There is no accountability from IRCC side. This is just becoming ridicules and shit show for individuals like us, if you ask me.

Yesterday, I had an appointment with the assistant of my MP, not sure if it will help my case... She told me that she will contact CIC and come back to me within 2 weeks.
Almost 13 months post-AOR. Currently under BOWP until July 29th 2019..
