Procedural fairness letter

good evening
we received in early October a letter of procedural fairness regarding the answer by "no" to question 6 of Appendix A, knowing that my husband was arrested in united states 18 years ago for a suspicion of DUI but since the test of Alcohol was in the standards no pursuit was made.
question 6 said "have you been found guilty or are you currently charged or tried or subject to prosecution in any country".
answering with "no" seemed to be the correct answer since there has never been a conviction and there are no proceedings against him.
The officer accuses us of misrepresentation and changed the context of the question by replacing "currently" with "do you already have",he says that this information directly concerns his criminal admissibility.
we filed our application for permanent residence for skilled workers for quebec since December 2016 and in February 2018 we sent the criminal record of the United States and explained everything about this arrest since it appears in the certificate of fbi as a charge of arrest but there is no court disposition
our lawyer has responded to the procedural fairness letter since November and we are still waiting for a response from the Cic. do you think we have a chance to be approved .
