Visitor in Canada, wanting to travel before PR application

A bit of a complicated situation:

My boyfriend (now common law partner) and I are in the process of preparing our PR application. Before sending it, we were wondering if it would be possible to take a 7 day vacation out of the country. My boyfriend was first here on a study and work visa, but now has status as a visitor here in Canada. As a visitor, will we be given any problems when trying to re enter Canada at the end of the vacation?

Thank you!

Does he have a valid visa to return to Canada? Is he from a visa-exempt country?

If he has a visa or is from a visa-exempt country, he can certainly attempt to re-enter Canada after a trip. He may or may not receive extra intention from CBSA. That's what dual intent is about - he can intend to apply for PR but also intend to respect his terms of admission to Canada.

He is from Italy and is currently in Canada with visitor status. Is he allowed to leave and enter Canada again and if so, what are the necessary documents he will need to present?

Italy is visa-exempt so he needs to have a valid ETA or get a new one before he attempts to reenter. That and his passport are the only documents he needs to attempt to enter as a visitor.

However, CBSA will ask about his purpose of visit and may choose to give him a shorter visitor record or deny him entry. A full denial is rather unlikely if he has always complied with immigration rules, but it is a possibility so keep that in mind.

Thank you. If the CBSA give him a shorter visitor record would it change his eligibility to stay would it if he is applying for PR inland anyways?

Not really, no. You just need to apply while he's in status.

"If he is applying anyways" - the only thing CBSA could do is either deny him entry, or give him a short entry that would mean he'd have to leave before you'd applied. So, I suppose the answer to your question is yes. But it's not incredibly likely provided he hasn't done anything against immigration rules in the meantime.
