Hi,

I have applied for CEC in mid-April, my PGWP expires in 1st week of July, hence I have applied for Bridging work permit as well. Now, I have scenarios where I was wondering if you could help me

1. In case my application for PR gets rejected, would it automatically mean my Bridging work permit's application also got rejected? In that case, would I have to quit my job if the application is processed after my work permit expires?

2. Putting down a scenario here, I am working at my job , get bridging work permit, after my PGWP expires, PR application gets rejected, then I am assuming bridging work permit is also deemed invalid?? However, what do at that time coz i am not on implied status, how to apply for visitor visa or even PR again. Does immigration dept. give you certain buffer time or i have to return immediately to my home country.

Any help would be very appreciated

AFAIK

1. Yes
2. BOWP is usually valid for one year. If your PR gets rejected when you are on BOWP, you can keep working until its validity expires.

Someone correct me if I'm wrong..

Absolutely wrong in question number 1!
If your PR application passes the R10 checks (which is a general check by case analyst to see if your EE profile has all the required documents and the documents are valid ...) AND you applied for the BOWP within 4 months before your current work permit expires, you will meet the eligibility requirements for the BOWP even if your PR application gets rejected! The PR application result is not in the requirements of a BOWP it is only the completeness check that is important!
I have seen someone who's PR got rejected and his BOWP got approved after his PR rejection!

Read below from CIC website:
https://www.canada.ca/en/immigration-refugees-citizenship/corporate/publications-manuals/operational-bulletins-manuals/temporary-residents/foreign-workers/provincial-nominees-permanent-resident-applicants/bridging-open-work-permits.html#eligibility_parameters

Express Entry: determining if an e-APR has passed the completeness check
If a foreign national submits an APR using Express Entry, they may apply for a BOWP if they meet the eligibility requirements. However, a decision on the application will not be made until the Centralized Intake Office (CIO) has assessed the e-APR for completeness. A BOWP can be issued only if the e-APR has passed the R10 completeness check.

Before issuing a BOWP, officers must check the Global Case Management System (GCMS) to ensure that the CIO has reviewed the application and determined that it meets the requirements of a complete application as described in sections R10 and R12.01. If the e-APR is incomplete, the application for a BOWP must be refused. The open work permit holder fee can be refunded, but the processing fees cannot.

Complete application: The CIO will enter the following note in GCMS: “R10 OK.”

Incomplete application: The CIO will cancel the e-APR and enter the following note in GCMS: “E-APR rejected as incomplete. Client not eligible for BOWP.”

Applicants applying for a BOWP must include a copy of their Acknowledgment of receipt - Application for permanent residence letter with their open work permit application.

1. No
2. Your work permit is valid even if your PR application is rejected

"rejection" and "refusal" are different scenarios, so the word choice is confusing.

1. In case my application for PR gets rejected, would it automatically mean my Bridging work permit's application also got rejected?
a. If your PR application is rejected as in complete ("rejection"), your BOWP will also be rejected

b. If your PR application is deemed complete and put into processing (AKA passing the R10 completenes check) and later refused ("refusal"), there are 2 possible scenarios. One, your BOWP is approved before your PR is refused - you can continue to work as long as your BOWP is valid, and perhaps have the chance to re-apply. Two, if your PR application is refused before your BOWP is issued, it will also be refused (normally - there have been a few cases where time lags have allowed the BOWP to be issued anyway).

n that case, would I have to quit my job if the application is processed after my work permit expires?
If your BOWP is refused, yes, you would have to quit your job.

2. Putting down a scenario here, I am working at my job , get bridging work permit, after my PGWP expires, PR application gets rejected, then I am assuming bridging work permit is also deemed invalid??
No. Once the BOWP is issued, you can work until it expires.

This would be the scenario if your PR application is rejected as incomplete - as soon as your BOWP is refused, you would be out of status, retroactive to the expiry date of your PGWP. You would have 90 days from that date to apply to restore status / change to visitor status.

BOWP is for extending your current work permit and as your current status is visitors you may not be eligible for it!
https://www.canada.ca/en/immigration-refugees-citizenship/services/work-canada/extend-permit/bridging-open-work-permit.html
It clearly says EXTEND YOUR WORK PERMIT. That being said I am not 100% sure! You should call CIC and ask! Other thing you can do is to find an employer and ask them to apply for a work permit for you. Then when that one expires you will be eligible for BOWP.

I have submitted my eAPR on May 15, 2020, and I got the AOR getting ready to apply for BOWP. I noticed a minor mistake that does not affect the score or credibility and I updated it through web form immediately with an explanation letter. I considered canceling but it is an honest minor mistake. My points are 493, and my application is complete.
Lately, I know that BOWP they give it for 2 years period. My question is, if anything happens with my PR application that required to resubmit it again ( hopefully everything will be fine) but just in case. Is it possible to reapply using my extended work permit?

Thank you
