H&C Application as alternative to Sponsorship of Parents

In order to even consider a H&C app, your father would need to be currently inside Canada, and should remain in Canada for entire duration of the processing.

The fact he has a spouse, and a daughter in home country to take care of him, would be a negative factor to H&C consideration.

I really don't know. If she is making the decision to become PR and move to Canada, then perhaps it will be seen your father is really not in H&C need else she would instead choose to stay in home country to support him.

Last year i married with my wife who is residnte of canada and now i have pr card.
My wifes father, mother and sister are now in canada but we are living in iran because taking care of my father.
We can not leave him alone for 3 years to sponseee him.
Is it possible for us to start pr application for my father by humatherian program?? It is very important to us because my wife wants to be with her family and i can not leave my father alone.

You can only start an H&C application for your father if he is physically in Canada. He would need to apply for a TRV and come to Canada before the application can be submitted. It can't be done while he's outside of Canada.

for those who face problems in meeting the requirements of the Sponsorship of Parents program or just simply are tired of waiting out the years of possessing times, you may consider the application for permanent residence from within Canada on humanitarian and compassionate grounds (H&C) for your parents instead. (Your parent should be in Canada on the time of application)

I can definitely say – it works. We filed the application to sponsor our Mother back in May 2010 and after 4 years of waiting our application was refused due to the error in calculation of our income with no right to appeal....

But we did not give up and next month we filed another application for our Mother based on humanitarian and compassionate grounds (H&C) and we've won!

It looks like our timeline is one of the fastest for the H&R applications posted as it took the CIC just 11 months to finalize it.

AIP (1st stage approval) July 31 2014
Medicals and Police certificate request December 9 2014
Decision Made February 18 2015
Landing interview February 24 2015

It has taken exactly 11 months! Our Mom is a Permanent Resident now and we can finally relax.

now, me and my wife are living with my father in Iran( in the same home). on the other hand all of my wife's family are living in Toronto(her father, mother and only sister). I can not leave my father alone even for a short period of time. what is the best solution for us? can we try HUMANITARIAN AND COMPASSIONATE APPLICATION? please help us to find the best way of action.

Your father applies for a TRV. You do not sponsor him for that.

An invitation letter is not required.

Thank you for this useful information.... I really felt bad after receiving the email from CIC that I am not an eligible sponsor because I did not meet 2015 and 206 income since they calculated my husband's gross pay and not net pay.

There is no final decision yet but if ever, this H & C is a good alternative.

My dad passed away in July 2018.

My dad passed away in July 2018.

The father would have to be in Canada to apply for H&C. Canada has a PGP program. H&C is not the way to circumvent the PGP program. In this case the husband has not even established roots in Canada. His father has been widowed for 20 years and he got PR 1-2 years ago so leaving his father in Iran was predictable. Also depression does not cause heart attacks. He likely had heart disease. Unfortunately your father likely doesn’t have strong enough ties to Iran to qualify for a TRV but you can try.
