Before I throw my questions, let me put here how I got to have them in first place and share a briefly experience how we all make mistakes, be you an applicant or CIC and its agents.
Me: Applied for permanent residency over 2 years ago under provincial nominee program, just myself I was single at that time. A year and a half ago I resumed a previous relationship, last year our child was born (they were back their home [France]at the time of birth). Then, last year, on august, they came here and we started to live in together, then my spouse, with a visitor visa at that time. Honestly, the deal in between us was, I`m talking about my logic, not immigration logic, regardless it`s the second one that matters of course, the desire of residing here permanently is mine all along, she came here to try the waters and if she liked she would proceed to apply for permanent residency, using EE stream because it would be faster than under spouse sponsorship. On September of last year I sponsored her for a work permit, it was refused due to a CIC mistake (yes, they do commit mistakes folks, far more than us applicants, but it`s usually kept low profile), on the refusal explanation letter it was stated as a reason ``spouse (me) is not a skilled worker``, and of course I`m, that`s how I got my pnp nomination. That mistakenly refusal came in February, the very next day we went to the states for a day and on our way back we applied for a work permit at the border, the officers made us wait a good deal, gave us a hard time, more specifically a young chick very determined to refused my spouse wp, so obsessed she was with it that, when we gave her the birth certificate of our baby as a common in law proof, (remember folks, born in FRANCE, therefore I dare you to guess what language it was written), she took it rudely from my hands gave a quick glance and barked back at us `` this document must be translated!!``
. Myself, quite as the ground warms, to the first rays of light and a birdsong shatters the still, replied peacefully, ``dear officer, isn`t Canada official language also eh... french? She didn`t show any sign of shameful neither apologies for it, instead called another officer from quebec to check the alien document she could not recognize as french even though she works for the government. Anyways, after finally they realized the CIC had made a mistake, we got her wp on the spot.
Elders from Delphic Oracle, I just mentioned the history above to show that we all make mistakes, some people are humble and confident enough to assume, some are not.
My mistake, I haven`t updated cic about: my marital status change, neither my child because of my (wwroooong) understanding, the permanent application concerned to myself only, with my partner not sure yet either if she wanted to stay here permanently or not I wrongly assumed that they are considered non accompanying family member therefore I shouldn`t bother to put them under my profile and waited good one year more to have it finalized. Instead, she could apply on her own at anytime, get an ITA and apply for pr herself. But after receiving the final determination interview letter where it specifies:
If you have recently changed any of the following without updating IRCC, please scan & e-mail WST-Landing-Enquiries@cic.gc.ca your update and document(s) immediately. Please also bring the original documents along to your interview.
These are NOT required unless any of these changes have occurred.
Marital Status Include a copy of marriage certificate, divorce certificate, etc.
Birth Certificates For all accompanying dependent children or Canadian citizen children
So after reading this, coming here for some clarification, went to cic website to confirm I must have had updated them regardless. I then realized what I have done that I can fall into misrepresentation, get my pr refused and be kicked out for the next 5 year. Who is the one to blame?! Me of course.
Fellows forum experts who have being here since dawn of times, please help me to walk through the valley of death, the immigration purgatory safely and alive, I booked a few immigration lawyers to talk to already but I want to gather as much information as possible to safely go over this sketchy situation, even if I add my spouse and daughter now and have to wait another year or so for a new final determination interview after all their documentation be checked, I would not mind honestly, I`m already prepared for it. But my concern is, by telling CIC the truth that I didn`t know I had to put them down under my pr application, although they are already here as temporary residents, I could be signing my own deportation and ban to return order because CIC would simple not believe it or find it not reasonable.
Please folks, help me to see pitfalls on this explanation. If along my explanation I m willingly state that they will not accompanying me on my pr application would that make any better, or is this thinking correct in first place? non accompanying but they are here with temporary visas?
To makes things more thrilling, because remember folks, nothing is too bad that can not get wrost, my own work permit (therefore hers) expires within a week from the scheduled interview. So if really things get bad now I will be in a kinda of tight spot. But if luckly they just start the process over and ask for her information, we should be fine to reply for work permit extensions while we wait for the pr process to be finalized, correct? Is waiting for a pr decision enough grounds for work permit renewal? (considering mine is under pnp nomination, attached to the employer, my circumstances havent changed, I`m still working for the same company, and possessing letter of support from pnp program for work permit application.
