Visitor Visa Refused over 179(b)

  1. Hello,

    I recently applied for a visitor visa to canada for myself and my wife. The reason for our visit is to attend my brother-in-law's graduation taking place in june, 2019. We have a daughter who is 1.5 years old and we are leaving her in our parents custody during our visit to canada. We intended to stay visit him for two weeks. We provided all necessary documents like,

    1. My business registration
    2. My wife bank employee - salary.
    3. Brother-in-law invitation letter- stating his graduation and he would help us with stay and food.
    4. bank statement
    5. other family details.


    But our visa was rejected stating
    • I am not satisfied that you will leave Canada at the end of your stay as a temporary resident, as stipulated in paragraph 179(b) of the IRPR, based on your family ties in Canada and in your country of residence.
      • I am not satisfied that you will leave Canada at the end of your stay as a temporary resident, as stipulated in paragraph 179(b) of the IRPR, based on the purpose of your visit.
      • I am not satisfied that you will leave Canada at the end of your stay as a temporary resident, as stipulated in paragraph 179(b) of the IRPR, based on your personal assets and financial status.
    I would like to know where I went wrong with providing my details.Can you help me with this. Thank you

Second:
Honestly, I'm not surprised why you and your wife have been refused.

1. You only provided the registration documents for your business.... without proving it is actively trading + without proving you get a regular, stable income from it which is a financial incentive for you to return to India.

2. Your wife's ties are her employment and your young daughter.

3. Do list the documents you had submitted + the finances available for your visit (not borrowed + must match your tax returns)

4. Do you own property or land (not your parents' properties)? Financial investments or retirement plans? Credit cards? Loans or mortgages?

5. Documents for your business? Is it sole ownership or business partnership? Profitable? Hired other employees? Audit report + Profit-Loss balance sheet? Office premises - rented or owned? etc etc

1. I thought only uploading my business registration is enough. I will make sure to upload supporting documents to it.
2. ok we will provide more details of my daughter too.
3. Yes the financial statement matches. But we only showed $8000 for 2 weeks of stay. Is that enough.


4. Yes i have land and other properties but i didn't submit them. Where should you show the personal assets in the application?
5. Also where should i include details about my family ties in the application? like daughter birth certificate, parents dependant on me, etc/
6. Is it enough to provide graduation letter of my brother in law for the purpose of my visit.

Please post the separate list of documents for your wife + yourself + your host

as we applied for visit visa, with all the required docs bank statements, property docs, Employment letter ,NOc , ticket bookings, insurance,
we have to go to canada as my daughter is pursuing her higher studies
surprising why it had to be rejected , now how do we go about it again , as i cannot allow her to travel alone

I have applied for my parents and my niece(sister daughter) visa as my sister will not come and her daughter will come with my parents.

I got reply from visa office. My parents visitor visa has been approved but my sister daughter visa who is 7 yrs old has been rejected on basis of 179(b) of IRPR. I dont why. I have even submitted consent letter affidavit from court from my sister who is giving consent for her daughter travel with grandparents. I have mentioned that she will return back as her parents(my sister & her husband ) is not coming so my niece will definetely go back to INDIA with my parents and i have attached the return airfare itienery also.

Can somebody explain me why they have rejected the visa of a minor when i am taking full responsibility and my sister has given all her id proofs proving her relation to me and her daughter with my parents. I have attached my bank statement of 17000 CAD for her support and my parents real asset worth.

Please guide me how can i apply again. should i declare my sister income proof or should i mention that my sister will also come with her daughter and reapply for both my sister and her daughter visa

Did she intend to travel during school time and you didn't submit her school absence permit?

The travel time is may 1st to May 20th and usually summer vacation starts from may 12th in her school so we decided that we will take leave from school little early as she is standard 1st only so that much school home work.

We didnt submit school absence approval or any such docs

Reason that the child is included in the trip ?

The trip planned for 20 days and as my sister & her husband cant come as busy in their professional lives but my niece(sister daughter) mostly live with my parents as there is no one in my sister in-laws family to take care of her so we decided that she will come to visit me with my parents.

I am not sure this is the reason they refused. However, Children travel during School time should submit Absence Approval.
