Help needed with ATL IMM1282

I was wondering if anyone could help me with my situation. I was in Canada on a visitor visa and went to border to change my status from visitor to work permit with an approved LMIA. My whole thing went down when they basically suspected that I have been in the co7ntr6 from a while and I must have been working. After going back and forth I did agree that I worked here helping my cousin, so the obvious they got me signing a declaration and was told to leave within one week from that day. I didn’t ask border officer much questions but she basically told me that I AM NOT ALLOWED TO APPLY FOR A WORK PERMIT FOR ANOTHER 6 MONTHS.

So I departed Canada within the time period and I was given ALLOWED TO LEAVE FORM IMM 1282. After coming to home country I was able to get my file and it was mentioned in the file about inadmissibility and not being able to apply for work permit. It’s been 6 months now and I was wondering what kind of advise you guys have for me.

It would be great if someone else had been in the same boat as me and if they can share their experiences that could help me getting back to Canada.

My advice? Good luck. You broke the law, and you will now have a much harder time proving that you will come to Canada and not illegally work again.

Since it has been 6 months, you can try. Start with ensuring an updated LMIA is procured for you which takes about 6 months so you have another 6 months to stay out of the country.

Whether you will be granted a work permit or not is up to the officer though. Wanting to come back to Canada as soon as the ban is lifted only adds to the suspicion that you want to live here.

Have you tried the express entry way?

Thank you so much. No I haven’t looked into express entry way, I’m not sure if I’m eligible to do so. I do have blood relation in Canada as my real sister lives there from last 18 years. I just hope I do have some options left to do everything right.

Express Entry is all about how many points you have. You need to have 440+ points to have a decent chance of being selected.

Have you calculated your points yet? If not, that's what you need to do next.

thank you. with this calculator, I have checked that I do have points and was wondering how long the express entry takes. also, the red flag that I have on my file won't be an obstacle when I apply for express entry?

Processing typically takes around 6 months but can take longer. Provided you are 100 honest about your past history it shouldn't be a problem.
