Not sure where to post this so apologies if it’s not in the right forum.

I graduated in December 2018 from a 1 year post grad degree. Before December 2018, I applied for another study permit for another 1 year program. This was to enable me get the 3 year work permit when I’m done with the second program

I am currently in the second 1 year program and I got a job offer from where I did my co-op for the first program. This job aligns with my NOC code, what I studied in the 1st program, plus it pays well too.

Just want to know if I can apply for a pgwp using my graduation letter from my first program, while currently holding a study permit for the second program?

I would stop going to classes as soon as I submit my application, also would the implied status allow me work once I submit?

PS: the study permit for the first program has expired.

This is the wrong place to be posting this.

However I will answer. Yous should be careful and read CIC webpage. The eligibility of your PGWP is such that you can only apply for it within 90 days of your study permit has expired or you met all your degree requierements (which ever is sooner). If you do not apply within those 90 days, you will not be able to get a PGWP for that degree.

In your case, your only option is to get a PGWP for your second degree, once you have completed the program.

Note: you are only eligible to get one PGWP once in your lifetime and it applies for the degree you just completed. In this case, you will be able to get it for up to a year (the same duration of the program you studied) and you cannot add the lengths of 2 programs in order to make your PGWP be longer.

You should have explored this before enrolling in a program.

Your option, in my opinion are:
  • Get a work permit by getting your employer to fill a LMIA, or
  • Finish your second degree, get a PGWP and then find a job.
Remember this is your only chance to earn canadian work experience to become eligible for the Canadian Experience Claas in the future. Else if you have foreign work experience, combined with your Canadian degree you might already be eligible to apply via Express Entry under a different stream.

Hi Wolf,

I got my ITA for pr under CEC. My employer has provided me with the referral letter but it does not include my benefits and job duties as per the company policy.
My colleague or manager do not want to write an official letter as well.

So all together I have the referral letter without the job duties, original offer letter which contains my benefits, the job posting printout for which I applied for my current job (this includes by duties and responsibilities), T4, paystubs.

Would this be enough as proof? Thank you

Hi! congratulations and kudos on your ITA.

Ideally the letter of employment should contain the duties as explained HERE

"The following documents are mandatory for each work experience declared:
  • a reference or experience letter from the employer, which
    • should be an official document printed on company letterhead (must include the applicant’s name, the company’s contact information [address, telephone number and email address], and the name, title and signature of the immediate supervisor or personnel officer at the company),
    • should indicate all positions held while employed at the company and must include the following details: job title, duties and responsibilities, job status (if current job), dates worked for the company, number of work hours per week and annual salary plus benefits"
However, if you cannot get your employer to provide this, for any reason, you should attach a letter of explanation. I think including the documentation that you have will help your case.

I would suggest you indicate what I pasted above in this post to your employer and tell them why it is important for your PR application to have a letter that includes this information. Also, request this in writing (via email). If the person in charge (your supervisor, manager) does not respond or responds negatively you should attach this to your application and indicate that after repeated request they refused to provide you with a letter of experience that includes all the details required by IRCC.

If you do all this you should be fine, at least you have the referral letter which includes these details so I think you will not have many issues. Also, I would suggest if your company has an intranet page, there is usually a HR section where they might keep documents with the duties for all positions in the company.
