Migrating to India with Canadian citizenship

Hi all,

Those who are reading this post, kindly please answer the exact process. We have a child who is born in Canada and received Canadian citizenship. We are Indian parents holding Indian passports and we wish to settle back to India soon with our child. To stay in India for a Canadian born child, what are the requirements to be done by us so that our child can do his education and work in India? Does the child require Indian passport? Does Canada allows dual citizenship? Does India also provide dual citizenship or not? Should we register our son's Canadian passport as Oversees Citizenship of India(OCI) so that he can travel back and forth to Canada and India after he turns to 18 years of age?

Appreciate any other additional information on this regard.

No offence but did you not do research before applying? You only got PR around 1.5 years ago and then had a child in Canada and now want to return. Seems like the goal was to make sure your child has Canadian citizenship, India does not allow dual citizenship so your son will be considered a foreigner.

No offence but did you not do research before applying? You only got PR around 1.5 years ago and then had a child in Canada and now want to return. Seems like the goal was to make sure your child has Canadian citizenship, India does not allow dual citizenship so your son will be considered a foreigner.
I just happened to click on Steffy92 profile and read her previous posts.
I feel she came to Canada as a Pharmacist and tried her level best but did not succeed in the licensing part . This is my guess.
Now she does not want to slog in some factory and ruin her career since she could be around 26 or 27 only.
Hence she must be planning to go back.
We have scores of immigrants pouring in to Canada but sometimes not everyone can endure the initial tough patch before becoming successful.

Thanks for the reply. But i have not received the exact answer that i wanted but rather read wild guesses and suggestions. Decisions may change for every person. It depends. So instead of judging, its good to say answers straight forward so that information passed won't be confusing to others as well who is going through same situation.

Some high level guidance is
1. Canada allows dual citizenship but India DOESN'T so if you need your kid to get Indian passport you need the kid to relinquish the Canadian citizenship else if its just a matter of traveling to India then OCI or India visa should work. You can get a India visa on the kids passport but its preferred to get an OCI.
3. The benefits of the OCI card can be read up on the website w.r.t education/travel/financial coverage/etc. The OCI is on par with the NRI status that India provides.
4. Your kids doesn't need a Indian passport as long as s/he has the OCI card. The kid can get OCI card since the parents have Indian origin. Pls discuss the same with the BLS contacts and confirm the current rules.
5. Since the kid would have Canadian passport s/he can travel back and forth to Canada however for you to travel you either need to have a valid PR or you need to get a Canadian visa (if the PR expires)

Getting Indian citizenship is not easy when compared to Canadaian citizenship... and also OCI card is not a complete citizenship .
Might not get same privileges as indian citizenship in indian public sector .

1. I heard that some stupid schools asks for passport. But these schools charge more hence it depends on the school you put him in. So call few similar schools you would join your son.
2. Some ask, most dont.
3. Doesnt allow.
4. You need OCI for him to stay for more than visitor visa period in India - have you applied for OCI yet?. I dont think you need to do anything for Canada as he is citizen.

2) no govt jobs , no vote , no defence jobs. Rest should not be a big problem.

There are thousands of Indian citizens in India with US born children (US citizens). In USbits hard to get permanent residency. It’s not a big deal.

Keep your child’s Canadian citizenship and let him live in India with OCI. It’s an investment for his future that will help him when he is 18 years old.

Q: Can a person registered as an OCI be granted Indian Citizenship?
A: Yes.
As per the provisions of section 5(1) (g) of the Citizenship Act, 1955, a person who is registered as OCI for 5 years and is residing in India for 1 year out of the above 5 years, is eligible to apply for Indian Citizenship.

Does Canada allows dual citizenship? Does India also provide dual citizenship or not? .. Canada allows but India does not allow. You can transfer Indian Citizenship to your son but in order to do that you have to give up his Canadian Citizenship as India does not allow dual Citizenship.

Does the child require Indian passport? .. Should we register our son's Canadian passport as Oversees Citizenship of India(OCI) so that he can travel back and forth to Canada and India after he turns to 18 years of age? ..... As it is clear that the child can not have both passports so only option is OCI. OCI is not a citizenship status and has many limitations. A person having OCI can live and work in India by law but how much this law is followed is another story altogether.

You can transfer Indian Citizenship to your son but in order to do that you have to give up his Canadian Citizenship as India does not allow dual Citizenship.
Canada does not allow parents to renounce their children's Canadian citizenship for them. I think India allows children born in another country that acquires the other citizenship to keep both until they reach the age of 18, when they would then have six months to choose which citizenship they want to keep.

OCIs can work in govt. jobs. They can vote or buy agriculture or plantation land.
