Dear Seniors,

I want to apply for Express Entry but I’m having some serious obstacles. Hence, I’m writing to ask your invaluable help. Thank you so much for reading my problem and helping me. I really appreciate it in advance.

My plan is to get the band scores I need in English and French and this step will consume at least one year from now. Then,I'll apply for the Canadian residency.

The problem is, I’m divorced with one child. The custody is with his mother but the court order stated that I will have to pay $80 per month as a child support until my son reaches the age of 18 years old. It’s been 13 months since I divorced and I owe his mother $3000 as arrears of child support because I have been jobless since then and I couldn’t and still can’t pay the monthly child support. What’s add insult to injury is that by the time I get my bands scores, it will reaches $5000.

For this and other reasons, I‘m planning to leave this country to make a better future for me and my son bring him to Canada later (maybe after 10 years).

I’m afraid that if I apply with this current situation, they will ask me to provide a document that proves I pay the child support and I have no debt towards my son, which will be impossible to get giving the current circumstances. Furthermore, my ex-wife will never allow me to conduct a medical exam for the child. In fact, once she knows that I’m planning to leave my country, she will do anything to prevent me because she’s an evil and wicked woman and that was the reason for the divorce.

To tackle this issue, I’m planning to marry her again. By doing this, I won’t have to pay the arrears child support ($5000), I will be able to get her and my son to conduct the medical exam, and I will apply and declare that my child and wife will not accompany me. For this, I will have to provide a proof of funds of 3 members of $19,092 CAD. I don’t have the money but my father agreed to sell his land in the countryside and give me the money as a gift.

will I be able to be approved with this plan and once I land in Canada I initiate the divorce process here in my country and support my son from Canada until I find my feet and bring him to me????

Otherwise, what are my options, and what is the best approach considering that my wife became a hooker and one of the worst individuals on earth???( Sorry but it's the truth).

Thank you so much for putting yourselves in my shoes. Please help.

What you are proposing on doing is fraud and you'll be committing misrepresentation in your application. You're not going to get help on this forum to commit fraud. You need to find a path to resolve this without remarrying your ex-wife when you are no longer in a relationship with her.

You should get the funds from your father, pay off the debt you owe to your ex, apply as a single candidate and find a way to convince your ex-wife to allow your son to take the medical so that he can be included as a dependent in your application. Note that in order to bring your son to Canada later, you will need your ex-wife's written permission.

Thank you for your reply, but she will never allow the medical exam to be conducted. She doesen't even let me see him. And if I give her $5000 I won't have enough money to prove funds?? I don't want to remarry her again as I have no feelings for her. But if you know any other way to do that I'm all ears? Please help!!

In that case your only option is to demonstrate that your ex has sole custody of your child and refuses to complete the medical. You will then have to exclude your child from your application as a dependent - which means you will not be able to sponsor him later.

It would help if you actually told the truth. In your other thread, you are still married.

Of course, you're right, because in that thread I decided to go with the plan of remarrying her again. But what's written above is the whole truth and nothing but the truth. I was also planing to include that I asked help about that plan in this threat. but I forgot to do that. But I swear that all the above was the truth. She took advantage of my kindness the first time. I just want you to put yoursef in my shoes. I know I lost my credibility. Since the first thread, I realised that I won't get help with shortcuts, that's why I decided to come clean and explain my whole situation in details in this thread.

If you think I should delete this thread, just ask me and I will do it. I'm in a muddle at the moment. but I'm honest and nice. I'll understand if you refuse to help. I made a mistake the first time and I applogise unreservedely. I sincerely apologise for the inconvenience and ask for your forgiveness.

But, I really need help!!! Kindly advise!!

Thank you! I'm not trying to fraud anyone. I just don't know what to do? I don't know the right path? I can't live in this country anymore!!

There is no way to prove her refusal as she will refuse to sign a refusal document to conduct the medical exam. Also even if she agreed to do that? What should I do about the child support?

I don't even know where to begin... You think it's OK to fake-marry a woman you call "one of the worst individuals on earth," and to deceive her about emigrating, to escape your child support obligations. Your father will help you raise 20K to fraudulently emigrate, but won't help his son and grandchild with 5K in child support... You think providing financial support to your child is "insult" and "injury". You plan to abandon your son in the custody of an "evil" woman for at least 10 more years... But, she's the evil, wicked one?

IRCC is not in the business of helping deadbeat dads abandon kids through immigration. (And make no mistake, by trying to flee your child support obligations, you are abandoning your kid). You would not be the first to try it, and IRCC is pretty good at deterrence. Even if you pull it off, if the fraud is reported after the fact, you could be stripped of your PR status and deported.

It looks bad when you see it from your side.

First, I'm not trying to escape my child support, I'm planning to vest the money once I find a job. Second, my father is taking really good care of my son at the moment by giving a monthly $50 to my ex-wife and if he gives me the 5K and I vest it to my ex-wife I won't be able to immigrate and thus my son and I will be stucked here forever with neither life nor child support. Also, if you know what my wife did to me, you wouldn't jumped to these assumptions. Lastly, I'm doing this specially to help my son for his own good. Without mentioning that my dad will be in a financial distress once he sells his property. But, I guess not anyone can put himself in my shoes.

No one is trying to judge you simply 3 advises from seniors

Dont try to do misrepresentation
You need to pay child support as you might need custody documents which will let CIC know that its pending or not paid. Once divorce is done and your ex have sole custody you need to meet income of one. You cant bring your child in future
Be fair and straight when applying for immigration.

Good Luck

Thank you, but I'm afraid that luck is not enough in my case. Once I paid the arrears of child support, my dream to leave this country and help my son and dad will end. Seriously, looking for a solution. As my wife is and will not be cooperative. she enjoys seeing me suffering.

According to your plan, you will be fooling your ex wife into getting medicals for your son in order to sponsor him later. Then you will be immigrating to Canada alone, leaving them behind but with the option of sponsoring your son later, for example when he turns 18 and no longer needs his mothers permission. However, what makes you think that your son would want to be sponsored by you at that time? Do you think after you fool your ex into remarrying you in order to cancel child support debt that she will encourage your relationship with your son? Even if he shares your opinion that his mother is the worst in the world, he will blame you for leaving him with her. So you may well end up with an 18 year old son who is estranged and doesn't want anything from you.

Also, if they told you to pay $80 per month, how can you owe 3000 after 13 months? It doesn't add up.

After each divorce, the wife gets a compensation wich depends on the husband's financial situation. I was jobless when we divorced, so the court sentenced me to pay $1200 for my wife. We were in an argument for 6 months before she filed a formal divorce claim to the court. After 4 months we officially divorced in Ferbruary 2018. As for the child support and according the court order, I must pay $80 per month which includes $40 (food, medicine, clothes...basic needs), $10 for the mom to babysit him and $30 for his accommodation. In total, $80 per month.

Now, let's do the math, shall we! Since Februray 2018 until now is 13 months. Right? multiply by 80 is equal to $1040 plus $1200 compensation for my ex-wife and we'll have $2040. Now, remember thayt 6 months that my wife and I were arguing before we decide to file a divorce claim. The law says that it counts like my wife was still living with me even if we were separated and she was living with her parents and thus I must sponser both her and my son in that period. So, my wife filed a separate file to the court to claim those expenses and after six month, she won and the court sentenced me to pay $950 including the accommodation, food, medicine, clothes, and all the basic needs for her and my son during that six-month period. Add $2040 to that last 950 and you'll have $3000.

No what about the $5000 (American Dollars) I mentioned above? As I have written above, by the time I get my bands scores in English, French, assessment for my degree, and the process of the application wich I estimate will be at least 2 years from now considering that my level of English is between 7 and 7.5 and I need 8. Also, my level of French is B2 and I need C1. All of this will take 2 years. The total child support will reach $5000 if you do the math again and add $80 for another 2 years.

If I take the money from my father who is indigent and give it to my wife who is in good financial situation, it leaves me with just $6000 and I will still pay around $250 to WES to assess my diploma, another $250 for IELTS , and another $250 for french TEF without mentioning the medical checks for me and my son, the translation for the documents, plane tickets and other unexpected expenses. All this supposing that I will get my band scores from the first attempt. If this happens, I won't be able to prove funds sufficiency and a job offer is out of reach.

Leaving my wife and son here and seeking for a better life, seems cruel, but I will be able to help my son, mysef, and my dad who will sacrifies his property to help me. If I stay here, I will not be able to financialy support my son or my dad or even myself.

It's a positive plan in the long term. As for the my ex-wife. She took me for granted, took advantage of my kindness, ruins my life and other serious scandals that I can't even mention them. Even though she's evil and wicked and even if I remarry her again I doubt my ability to ditch her again as I can't and never fooled a person in my life. Long story short, without a viable solution from you, me dreams, my life ,my sons's dreams and life, and my dad's life will be in an extremely difficult situation in a country where there is no justice, no education, no job opportunities, oppression, and no health care and most imporrtantly, people are illiterate.

Easy to sit behing a phone or a laptop and judge people, but it's quite difficult to put yourselves in others' shoes. May God bless you all, heaveans accept you and problems neglect you.

Well, now you know everything. It's up to you to help make people's dreams come true or just watch them suffering.

No body wants you to suffer that's why no one is giving you -ve advise to commit further fraud. Everyone here is voluntarily to help people. This is also a help to guide one to right way instead of pushing you to go for misrepresentation.

You already got 6 senior replies which no one gets usually. Probably you want to hear the answer you think is correct. They already told you future road map.

If my son refuses my support, then, it's up to him. I will prepare him a better life and save money for him, for his education, and further expenses. It's better to suffer first and compensate latter than to live miserably for his whole life.
