Question on Soft Landing

Details:
  • I am a primary applicant
  • Wife is dependent
  • Current Residence - Both in the US on H1B visa
  • CoPR valid until May 2019

Can my wife do a soft landing first? My H1B transfer is still in process and do not have approved petition for a new employer.

Our problem is if we wait until I get my transfer approved, by that time my wife will have to file for extension. She can only do a soft landing within next 2 weeks and obviously I can't do a soft landing right now.

People have answered for this question in other forums saying primary applicant has to do a landing first. Can anyone share an official link which states this? I couldn't find a link to CIC website regarding this.

I couldn't find it either .. but it is absolutely true that you must land first as the approved file is under your name and no hers.

It's strange we aren't able to find an official link and yet we are following what other people are saying, Nothing against you, it's just little frustrating.

Quick Update:
We did soft landing via peach arch border crossing, there were a couple of hick ups though.

(1) While crossing to canada, 3 people worked on my case for landing and no one asked me for address to send PR card. I asked the last officer and he said the previous officer already submitted your file and now changes cannot be made. He gave me a phone number to call and change the address. What a bummer!! Advice to you all, make sure you keep reminding them about the address while they are processing your file to avoid this.

(2) While returning back, I was referred for additional inspection since I had no H1B stamp and last time I left country was 10 years ago on F1. Inside, officer asked a few questions and then gave me a new I-94 based on current petition. Advice to you all, carry all your passports, at least the one that has the last visa stamp and H1B petition.
