Brazilian wife and British husband apply for EXPRESS ENTRY

My fiancé and I have been in a long-distance relationship for almost 5 years and plan to be getting married this year after he finishes his 2nd masters. My soon to be husband always wanted to live in Canada (mainly after he worked there in 2015 for 11 months on the Pan American Games). So, we decided to apply for the Express Entry.

Although we will be married, the process to get him to live in Brazil legally is much simpler than the one to grant me the right to live in the UK. For the UK it is necessary to apply for a Visa, it's an expensive process, it takes up to 3 months for them to give the final result and it lasts only for 2.5 months (after that you have to fill in a new application for another visa).

Because we both want to live in Canada, we don't see a reason to go throw a much more complicated (and expensive) application process if we're going to apply to live in Canada. So, after the wedding, we plan to live in our birth countries (continue to visit one another) and apply for Express Entry. Hopefully, we will receive the ITA soon after application, and we can keep the UK visa application as a backup, let's hope for the best.

Which brings up my question: how does it work for married couples with different citizenships to apply? Will this raise a white flag? My then husband will be the main applicant. Does it add different steps, extra documents and scrutiny of the process?​

I could not find any information on this in the forum (maybe I didn't use the right words in the search). Our marriage certificate will be apostille to be internationally legalised (and recognised) among the Haia Convention country members (e.g. the UK and Canada).

Here is my background: I have visited Canada before (with required Visa), and I legally lived in the UK for 1 year (with Student Visa, also how I met my fiancé). Since then, and over the duration of our relationship, we have relied upon 6-month travel visas during our respective study programmes. We have concerns about demonstrating evidence in the form of shared utility/bank and such as bills since my fiancé has everything in his name.

I would like to ask, is it required that I provide Police Certificate from the UK for the time I was there studying and also from the visits? (along with the one from my country of residence Brazil)? Is it required that my fiancé provides a Police Certificate (Certidão de Antecedentes Criminais) from Brazil for the time he was here as well as from the UK too?

Secondly, and if we get lucky - fingers crossed, when it comes to sending the passports how it will work for us as we will probably be living in different countries?

And finally, how long does it usually takes for applicants with CRS score over 450 - 460 (depending on our IELTS results) to receive the ITA?

Any tips and knowledge that you can share with us will be deeply appreciated. #THANK YOU#

If you lived in UK within the last 10 years, yes, you need PCC from there. From Brazil too. If he lived more than 6 months, in fact even if it's shorter, he needs to get one from Brazil as well. Try to get them after visiting respective countries before you apply.

Your issue is probably going to be that you don't live together, but with extra material such as wedding photos and such, it should be ok.

Passports can be sent to offices separately, you in Brazil, he in UK.

For country you are currently residing in, within 6 months.
For countries you visited in the past, the police certificate has to be dated after your last departure from that country.

There will be a slot in the application form where you can upload additional and optional documents.

PCC from the countries visited should be after you visited last time.

From the countries you live, they should be closer to the application time. Their official requirement is 6 months.

You can add it to your Letter of Explanation by making a word file and including such things. Of course, you will have a limit on the file size, so you would have to include only essential ones and wait for them if they ask for more documents.

If your husband doesn't live in Brazil but has visited for more than 6 months, he will need one, and you will likely need the UK PCC as well. I'm not sure how the process is for Brazil PCC for foreigners who are not living in the country, since the online one requires CPF and RG (or RNE in case of foreigners).

Thank you for your reply. Are you Brazilian? I ask because you know our official documents (CPF, RG, RNE) if not you're a very well informed person.

I guess it will be tricky to find out how to get this police certificate. It's especially complex because it's hard to find someone who's been in the same position as us and shared it online. Probably I will have to contact the Federal Police to ask directly to them.

Yes, as the other replies mentioned we both will need PCCs from both countries.

Have you applied for Express Entry before? Any tips I should know?

You don't have to write, but you can.

You could explain any issues or details that could confuse people, or just give a brief outline of your case. Some people say it's better to keep it in one page only. Of course yours will be longer with those extra materials.

As I mentioned, it's likely that I will visit my then husband in the UK. How do we proceed if I'm in the UK when we get the ITA? I can get the Police Certificate, but obviously it won't be dated after my departure from it. Is this a problem? What should we do?
