I'm saying you can't get married again because you're already married to your husband. There's no divorce in the Philippines, but without an annulment you can't get married again (you can't get married either way in the Philippines since it's a same sex marriage, but you could in Canada if you weren't already married).

So you need to first apply for a TRV and see if your partner can come to Canada. If the TRV is approved, then you can live together for a year in Canada to qualify for common law. If the TRV is denied, you can apply conjugal.
