TRV for spouse sponsorship application in process

Hi all,

I need expert advice on a matter as I found that getting visitor visa for spouse with sponsorship application in process is complicated.

I filed for sponsorship of my wife in July 2019 and current status is "Background check in process". I think it might take another 4 to 5 months for final approval so I want to apply for her TRV.

I got the list of documents etc from CIC website but few concerns are:-

1. My spouse is on contract role ending on March 2019.
All documents from her employer are ready i.e. leave approval till March end and certifying that she works there.

2. She has no property or asset directly on her name e.g. home or car but bank balance and salary records etc.

How to make her case stronger for showing strong ties to home country?

Does an evaluation from CA for my parental home and other assets like jewellry would help?

Does booking return air tickets help?

What else can make case stronger ?

Also for showing duel intent, is there anything special tobe done or just mention of PR file in process is enough?

It will likely be very difficult to get a TRV approved. The fact she has a spousal sponsorship application in progress significantly lowers the chance of approval. The fact her job is contract and ends soon will work against her as well - as will the fact she has no property or assets.

Do not book the air tickets. This doesn't demonstrate that she will return and if the TRV is refused, will end up being a waste of money.

Is there anything she can show to demonstrate ties that you haven't thought of? Unfortunately her case looks extremely weak right now.

Dual intent only means that she is applying for a TRV when she already has a PR application in process. There's nothing to be done to inform IRCC because they would know right away when she applies for a TRV.

Based on your post:
1. Your wife has only employment ties but those end in about a month.

2. Your parents' property and other assets cannot be shown as reasons for her to return to her home country.

3. If she is able to extend her employment contract for a few months beyond March + if she can prove she must return to collect some financial benefits or she must return for some critical work reasons then a TRV approval might work.

4. IMO, she could be issued a short 1-year TRV if the background checks are completed soon. Nonetheless, she must prove #3 or similar ties when she applies

Hello there!
Just wondering about Visitor visa extension and get refused.
I applied for extension for my father and get refused. He exit 3 days after we receive the refusal letter. And planning to come back again after 2 months.. Can this be be affect on his next entry to canada? His visitor visa will expire next year.

How long did he stay on his previous visit? When did he leave?

Hi there! He came last year
February 2 and before 6 months we applied for extension thats the month of july. We got approved and base on approval letter he is until january 16 2019. So december i applied him for extension again. And we just got replied from cic february 8.. so it's 1year he stay here. Thanks for reply

Maybe IRCC has concerns that he is living too long in Canada which is not typical of a visitor. IMO, he must remain in his home country for about 6 months before he attempts to re-enter.

If you're eligible, you may want to consider applying for a super visa instead for him. That way he can stay for up to 2 years on each super visa entry

Thanks Bryanna ! I will check what can be done regarding that.

My wife has to come back for helping my mother with her treatment in May 2019. What is best way to mention this in the application?

Also letter from employer does not state that contract is ending.

Does your wife live at the same address as your mom?
Any scheduled surgery? Is it a critical medical condition? Can your wife provide evidence for this?


Also letter from employer does not state that contract is ending.

Hi Bryanna,

The recent letter issued just states that she is an employer with her salary and another letter for leave approval.

Yes she lives on same address with my mom and I have my elder brother but my wife is nurse by profession so she can better handle the case so she is required. But I got your point that we need to provide proof for the treatment.

That may or may not be sufficient. But what can be better way to present it ?

Another simple question, the application for spouse sponsorship has been linked online to account with my details. Can I use same account for TRV for my wife or does it have to be new account with her name ?

Does notarizing letter of support helps or plain document is treated same ?

Even if it is bit better I will go for notorized.
