Hey guys,

Need small help I got ITA on single applicant but my wife is here in Canada but she don't want to stay here in Canada. So, I didn't included here in my application. So, Do i need to write an explanation letter ?? please let me know the good idea what should I have to write in LOE. Thanks

If you are married, you CANNOT apply as single, that is misrepresentation. I do not think you can correct this post-ITA, you will likely need to decline the ITA, correct your profile, and wait for another ITA.

Unless you get divorced, you must include your spouse in your application, either as accompanying or as non-accompanying. Spouses have to provide PCCs and a medical exam, even if non-accompanying.

The problem with declaring your spouse as "non-accompanying" is that she is here in Canada now (that is, she has already accompanied you), non-accompanying is for spouses who do not come to Canada. So declaring her as "non-accompanying" might not be credible. When does she plan to leave Canada?

So now I am more confused... why would she do those things if she didn't want to eventually live in Canada? (It sounds like maybe the truth is, that she does want to immigrate to Canada, but you want to exclude her because of the impact on your CRS score).

In any case - you have submitted your eAPR... your status was single? And you submitted a Letter of explanation about your wife... is that correct?

So, here's the best case scenario - since you did discuss your wife, they could take it as a mistake, not misrepresentation. And then your status could be corrected to "married" and either returned as incomplete (since you did not submit your wife's documents) or your CRS score will get recalculated to include your wife; if you no longer meet the threshold for your draw, your application will be refused as ineligible.

If you did want to cancel your application, you can, but you would lose your application fee.

Two (possible) benefits of canceling - (1) you don't have to wait as long to start over, to submit a new profile. (2) avoid any chance of IRCC seeing this as misrepresentation.

No need to withdraw the application, but not sure if IRCC will accept your explanation. Basically, you are trying to game the point system (cheat) by declaring you wife as non-accompanying, but some people have succeeded this way. You will have to go through the hassle of sponsoring her later, that is perhaps punishment enough :)

In the explanation letter I mentioned that I am gonna apply when she is done with her ielts and wes evaluation... Is that fair enough

It's simple, you just apply and claim points for your stuff but of course you'll have to say you're married.

CIC explains this in their website where they specifically indicate that you can apply for yourself only if it's just you staying.

It's not cheating, it's totally legitimate. You can always sponsor her later indeed, but that's a whole different story.
