Hi Friends,

We are looking for some help on filling out and declaring non-residency. The spousal sponsorship advice from this forum really helped and my wife was successful in her application. Thank you! However, we are once again on the move...

My wife and I married in Vancouver in 2016. I am a Canadian Citizen and she is from the UK. We resided in Canada and worked until July 2018. My wife acquired her PR Status via Spousal Sponsorship during this time. All taxes are filed up to this current tax year - 2018. We relocated for employment in Asia in September 2018 and have since lived and worked abroad. We are looking to declare no-residency for tax purposes as it looks like we will be residing in Asia for the foreseeable future. We have no houses or property, cars etc in Canada.

1) We are both completing NR73 Determining of Residency Status Form and will mail back to Canada - wishing to declare Non-Residency; We are unsure of what to select under the Relationship Section if we are Factual. Deemed, or Non-resident. It states if you are unsure to complete form NR73 (which is this form). Does this mean that I leave this blank and let them determine our status?

2) For my NR73 form, I wish to keep my Canadian Passport, Drivers Licence (to visit my parents who are retired in Canada once a year so I can rent a car) and Bank Account (to continue repayment of student loans). I simply just check "You will have a valid Canadian Passport" , "You will keep your driver's licence in Canada that are registered in a province or territory of Canada", and "You will Keep Bank Accounts in Canada - stating my repayment of student loans as reason:"

I have heard stories that if you declare non-resident, that the gov will confiscate some of these things like licences and bank accounts since I am no longer residing in Canada. Is this true? I plan to visit home once a year so these are important to me - to be able to drive and to pay off student loans. I have a left a set amount in the account (no money will be now be deposited), just to pay off the student loans

3) I heard another way to declare non-residency was to check an option under the Tax Return form of the upcoming year. To my knowledge - my wife and I will pay taxes for 2018 from May 1 2018 to July 2018 (before our relocation). Is this correct? As we are abroad, we wish to get as much info as possible so that we can get the Tax forms in on time, and if there is an option to declare non-residency on said form, it will be really convenient.

I am not sure if this is in the correct category, but the Spousal/Family section have many knowledgeable users and any help is greatly appreciated! Thank you in advance!

This is actually something I am going through right now. We looked for paid help to determine our residency status and the accountant said it would cost $2,000 to do this! Will be following.

I wouldn't bother with NR73 unless requested by CRA to fill it out.

The Canadian government will not confiscate your bank accounts or DL.

There is a section on your 2018 return where you will state that you have left Canada.
