Single mom and international student with Canadian kid

Hi ..
i am a single mom and i got fully funded scholarship to pursue master.
i have an acceptance letter to study in Toronto.
i am not Canadian but i have a Canadian kid -6 years old.
i applied for a study permit and soon i will get the result.
please note that his father gave me all his legal documents and a written permission to let him come with me.
my question is can i take my kid once i get my study permit? i won't face any issue in the border?
is there anything else i should consider?

If you have legal custody of the child, the child has a Canadian passport, you sure can bring him with you. Hopefully your study permit gets approved this time.
should i include my kid in my study permit application or no need cuz he is canadian?

You should mention in your family information form, also in the same form you need to mention that he is going with you. You don't need to get any additional visa or permits since your child is a Canadian citizen.

i will definitely include my kid in my family form.
but what happens if i didn't mention that he is accompanying me and then get the study permit approval and travel together ?

That would mean misrepresentation. Right on the form it is written if he is accompanying you. If you are lying and caught you will be banned from Canada for atleast 5 years minimum.

Why do you not want to tell the visa officer that you son is traveling with you ?

it is not that i don't want to tell. i am only suffering from getting his passport from his dad. he wont give me my son canadian passport thats why i am confused. but from my heart i do want to accompany my kid.
lets assume that i got approval and i went alone. my family will continue putting pressure on him to give me the passport, and if this happened (even if it was after a year from my studies) then i return to my country to pick my kid to canada.

Is the father in Canada or in your home country where you are currently based.

As of right now, you cannot bring your child with you as he does not have his passport and as a single parent, you need to get written consent from his father in order to travel.

Does your child physically have a passport that is being withheld or is he refusing to do the formalities that you get a passport for a child?

You really need to speak to a lawyer regarding this as this seems to be a complicated issue. As of now, you should not mention that your son is traveling with you as he cannot travel without his passport which is required travel documentation. If you are successful later on then you can bring your son without any issues.

If your son is older than 16 he will have the full rights to his passport. If he's a minor unfortunately his father has the rights to keep his passport from him. Ideally, it should be with someone who he's living with but that's the situation.

My suggestion would be either talk to a lawyer and see how to sort this out, I don't know the custody laws of my own country let alone yours. If there is a legal way you should take it if you want your son to go with you right now.

Alternatively, you don't take your son with you right now and get the issue sorted later and bring your son then. No, an airline will let someone board without a passport I'm afraid.

Yes, you can do that. Proceed with your study permit and don't mention that your child will be accompanying you. Once your child gets his passport problem solved then he can join you. What his father is doing is not correct as he is depriving your son of the opportunity to travel on his passport when he is not in custody of him. I would suggest that you go to the Canadian embassy with your child and ask for help there, however that could cause issues with his father and you still need his consent if he needs to travel with you. I'm not sure if you need consent if you're traveling back home. Like I said you can contact a lawyer or go to the Canadian embassy. A passport must be in access of the holder, at least in my opinion.

I think the main things to keep in mind are that you will need the other parent's written consent to bring the child to Canada (assuming the other parent isn't coming with you). Also to budget for childcare expenses. Child care is generally quite expensive in Canada and you won't be able to bring your baby to classes with you. Colleges often have child care facilities on site. You should contact Centennial to find out if they have childcare for international students, if there are spaces in the program or if there is a waiting list, and what the costs are.

Also - if your aim is PR, make sure you take a two year program (not a 1 year program).
