Hello,

I was able to submit an application to sponsor my mum.
My wife and i meet the revenues requirements for the last 2 years but not for 2016 as we immigrated in April and started work shortly after.

Would IRCC consider a prorated revenue based on the number of months we lived in Canada that year or would they still consider the full year revenue?

Thanks

I just wanted to update you on this. My mum landed 2 days ago as a PR, our application has been approved ;)
And yes IRCC considered the prorated income for 2016 so please make sure you double check before answering people.
Cheers!

Actually, they denied the application but we submitted a letter with all the additional documents/info. Our case was approved shortly after
So your prorated Income wasn’t approved and you actually never qualified to apply when you did. You received a PFL and made an argument about why you should be approved. Assume it was that you have made significantly more than LICO from 2017-2020. You were approved but you could have also been easily denied because you didn’t meet the terms to apply in the first place. Total income that you made in Canada during the first year has always been the requirement no matter when you moved to Canada.

I got denied because there are bureaucrats looking at our files. They just look at a number and if it doesn't match you're denied.
I made an argument because it doesn't make sense to assess someone on a full year when he only lived here for 8 months. I won my case, period. People are probably still mad, I'm happy

The rules are the rules so it makes me upset that many would not have applied because they followed the stated requirements in order to qualify. Did the response to your PFL actually say that you were approved because they accepted the argument that income should be prorated based on the amount of months you spend in Canada? Based on the many appeals that I have read there are some sympathetic members who would have considered your income from 2017-2020 if you made significantly higher than LICO and not meeting 2016 would be ignored. In the examples I have read it is often for applications that have been in process for a very long time so whether they didn’t meet LICO 5+ years if discounted if they maintained their income above LICO for the many years after that. The fact that you only had 3 NOAs when you applied because you had only recently moved to Canada and one of the NOAs didn’t meet the LICO makes the situation even more unusual. Longterm presence in Canada and many attempts to secure a PGP spot is another reason where not meeting NOA for one year out of many years of meeting NOA is sometimes overlooked. Not meeting NOA is usually for a temporary reason like pregnancy/mat leave, job loss, severe illness that has been overcome, etc.
