Study Permit and Criminal Record

I have a question, regarding Canadian Study Permits. It says that one of the requirements for obtaining one is to not have a criminal record. Does this mean that if you have anything whatsoever on your record, you automatically become ineligible for the permit? Or would they still assess you based on the nature of the offense and potentially give you a permit if it’s a minor offense?

In my case I’m concerned about a UK caution for Sexual Activity in a public place (without danger of witnessing). I was NOT arrested, charged, or convicted, but it is currently on my record. Would I be able to get a permit?

Yes, you can get permit if you are innocent, don't worry about it. Tell everything truthfully.

Its okay if its on record.

It depends to what that offense would be in Canada, dont think you even need to mention a caution on your application. Pretry sure it asks about conviction s only.

But I’ve given my biometrics for the caution, and I have to submit them for the application. Wouldn’t it be bad if they see a match and I haven’t declared my caution?

I dont think so since the forms asks for arests or convictions so you answered honestly.
If you are woried then answer yes and explain that you were only cautioned and never arrested or convicted of anything. Then IRCC can decide for themselves.

Hi I am in a similar position. Arrested 2013 with no conviction, released with NFA (theft charges). I was only 13 so heard since I was so young this wouldn’t affect my application. Can I ask how your app is going and if you’ve experienced any problems? Can anyone advise me on mine? Thanks

You have to be veracious by declaring it and stating exactly as you've explained here. It won't affect only if you is truthful
