Hello Everybody,

I am about to submitting my application and would like an advice regarding my case:

I am married and want to immigrate with my spouse, but I have had another marriage many years ago (8 years) in another country which has finished with a divorce. (I do not have a divorce certificate but can get a copy of the judgment from the court that pronounced the divorce)

The issue is that in my actual Marriage Certificate my previous status it is not "divorced" but "single" as first marriage wasn't transcript-ed in my country but only in the country of my first spouse...

Can this be an issue for me knowing that I have no relation at all anymore with my first spouse and having a divorce pronounced from the court many years ago?

Please need some advice,

If you apply under express entry divorce documents are not required, spousal sponsorship is another story. Best of luck

I wouldn't be concerned about it, if the system asks you at some point if you have been married before: be honest and disclose the previous marriage, and if it ever asks you proof then submit the evidence you have (copy of the judgment from the court ).

I don't recall any question during EE process that would require you to disclose your previous marriages. If you have children from previous marriages then you would have to list them out though.

You can explain this concern (and any others that you may have) in your Letter of Explanation specifically and truthfully. Remember this is going to be a long process and you don't want to worry all along (till the decision comes through) about this situation. Explain it and forget it. Good Luck !

That's what I was thinking to do, but knowing this is a long and difficult process I want to put all the chances by my side and not getting burnt on small details as this one..

thank you for you answer

When you start applying, you will be asked about previous marriage if any, declare truth fully and also provide the divorce judgement copy. Additionally, provide a letter of explanation and any other document to support your status mentioned on your current marriage certificate.. if you are able to provide all at one go with a reasonable explanation I do not see a reason for delay on this issue...You will be at peace throughout the process even if its delayed
