Non accompanying dependent

Hi Folks, Merry Christmas to you and your family!

I have a question regarding my EE I am struggling to find the answer, but it is quite confusing for me to be honest. I can't get any response from CIC either, so perhaps someone can help me.

I applied for EE and it is in the process, I am divorced and have a kid, 5 years old, which is back with her mom in Moscow. My kid has status as non accompanying dependent im my online application.

I am living in Canada for last 3 years on my working visa.

Recently I received a request for additional documents, IMM 5604 and IMM 5646 for my daughter. I can understand why they need IMM 5604, but form IMM 5646 does not make much sense to me as a) my kid is not coming to Canada at this stage b) why do they need a custodian if I am the legal parent and living in Canada. I was thinking that I need to put my name into the form, but it is required that custodian is a Canadian citizen or permanent resident, I have temporary residency so I can't be custodian..

What will happen if I do not provide these forms at all, I do not need PR for my kid at this stage. Can it be the cause for the full application refusal or just for my kid? Since I have score around 800 and all my documents are in order, I am not concerned about not getting PR approved, but I do not want to reapply from the scratch and loose another 6 months....

Requesting IMM5646 is an error. It applies to international students.

IMM5604 is only required when the child is actually immigrating, not for non-accompanying dependents. Are you sure you indicated that the child was non-accompanying? If you did, this request is an error as well.

Send an urgent Webform explaining the situation.

Many thanks for your reply, I am pretty sure I indicated that I apply just for myself, I was surprised that my kid was still required to do medicals and etc, which we did just in case. Perhaps they want consent IMM 5604 for future? I submitted web form regarding IMM 5646 though, will share my experience once get any feedback from CIC.

P.S. What I am curious about - they state in the additional info letter that if I fail to submit these two forms in time, they will keep processing my application without it, I guess then it should not impact mine application.

Medical, yes, that was definitely required.

The IMM5604 grants permission for the child to immigrate with you, which isn't happening if s/he is non-accompanying. If you were to sponsor the child in future, that is when you would need to submit the IMM5604.

Generally, when they make that statement, it is more "you need to submit this but if you don't, we will keep processing and likely refuse the app". Send another Webform stating that you are including the child as non-accompanying and so IMM5604 is not required.
