Please Help me !!


My wife refused from study permit visa for these reasons:

• I am not satisfied that you will leave Canada at the end of your stay, as stipulated in subsection 216(1) of the IRPR, based on your personal assets and financial status.
• Pursuant to paragraph 220(b) of the IRPA, I am not satisfied that you have sufficient and available financial resources, without working in Canada, to maintain yourself and any family members who are accompanying you during your proposed period of study.


She apply with scholarship letter for $20K and money in bank $17K, We are 4 family member(she , me and 2 sons) so they need($20k + Tuition =$7K per year ,the total they want is $27K and i have $20K+$17K)
Also she apply here car and my lot of Real Estate contracts.

My question
1-What is my weak point in application?
2-What i must do to make my application powerful in reapply?
3-I must update all documents again in reapply to visa or used the old supporting documents?

To get the accurate reason of refusal you need to apply for CAIPS notes. There are many websites offering such services but the one mentioned here in this forum a lot is CAIPS gcms.

To answer your question

1-
You have no ties to your home country as you are taking your entire family with you.

You haven't told us whether your wife's program is1 year or more than one year. If it is more than one year then she does not have enough money to support herself, you and your children.

If it is a one year course they will question why your wife wants to pull your children out of school for only one year when you are supposed to return back to Canada after your studies.

Assuming you and your wife share the same amount of English proficiency then that is also a negative point.

Basically, when applying for a study permit they want to know that you will return back to your home country even though there are programs like PGWP which allow you to work after graduation.

With that in mind, the visa officer will question why she wants the entire family to move for just a year. As I mentioned for more than a year you don't have the required finances. The bulk of your money is a scholarship letter which covers only tuition fees and will not cover your living expenses.

2- If your wife genuinely wants to study then you will have to think of the possibility of her going alone to study in Canada and when you have the required finances will she be able to bring you all.

At this moment you only have the financial capability for your wife and yourself to go to Canada for a period of 1 year.

You can consider getting a loan for the balance amount and show that as proof of funds if you all want to go but that will make your application weaker as there are no ties back to India. The visa officer will think that you are just using the study permit to get PR or to stay back in Canada illegally.

3- You can use the same documents, medical certificate can be submitted again but in my opinion you will need a lot more proof of financial funds to get a visa sucessfully.

Think its tuition + 10K(her) + 4K(you) + 3K(son) + 3K(son) + costs of coming to canada.
Since the reason given is finances focus on improving that part.

I already order the notes but i didnot received it yet. My wife program is PhD with min. 4 years study.the university need 6 ielts and she get 6.5.
I apply with her as visitor because i will stay in my country but i aplly forvisitor to visit her every 3 or 4 months.about ties to her country as following:her job, her old father and mother, my assets with her car.
1-what do you think , how much money i must put them in the bank ? For 1 year or for 4 years?she have a letter of scholarship with 20k CAD per year
2-what is better when she reapply. I will apply with her as visitor or not? And if no how can i visit her one week every 4 month?
3-if i make an authorization paper for her for my assets to allow for her to buy them. It will help?

The total is 20k+7k+4k for round trip tickets. Total is 31k . I apply with 37k(20 scholarship +17 in bank(

1- You will need to show finance for the entire duration of the program that is 4 years. IELTS could be improved but the main issue for rejection is the finance part.

2- It would be better that she first apply for a study permit and then once she is settled in Canada you can then process a visit visa application later. You can also mention you want to help her settle down and that's why you are accompanying her and obviously, you can't leave the children alone. If you are applying yourself you need to mention in SOP that you are only going temporarily to help her settle down, it is better to mention that.

3- If you are having the assets in your name you can be her sponsor. You will have to make official documentation. I am not aware of the procedure but if you make a separate thread then other members will surely help.

The most important point is you need to show that the purpose of travel is to study and not to settle and you need to show adequate proof of finance.

If they are living in Canada with your wife you will have to plan for childcare costs which can be $1500/month if you have a child in daycare. Older children will likely need after school care.

I'm not giving a figure but your previous calculations were too low. How old are your children? Where are you moving?

I just read your profile. Still unclear if you are both MDs or pharmacists. Are you aware that you likely will never be able to practice medicine in Canada? Why don't you just apply for EE and do your ielts? Don't start the PhD if you plan on quitting when you apply for PR and get accepted.

she have scholarship now and it will start in May, so no time for EE

You have been posting about immigration since last summer. If she actually plans to complete the PhD go for it but if this is to try and get into Canada a few months earlier that's not a good plan. Although your expenses will not be as high as some other cities. Your wife probable needs to show closer to 30k. The flights alone will be expensive plus you need to show how you will continue to support your family for 4 years.

I dont get your math, how much is tuition total for 1 year? But I think as other members have pointed out since you will both be in Canada with children the concern might be how you are going to bring in future income for following years. Are you getting an SOWP?

tuition is 7k per 1 year including books and fees.
I apply as visitor and write in letter that i will not leave my job and my country and i just want to visit her once every 4 month.
1-So how much i must put in bank?
2-When i reapply. Which is better: i apply as work permit or not apply (she and my childerns only apply)?
