Inadmissible students Due to violation(s)

Pretty much a textbook case. Its only a matter of enforcement. I know having been brought up in the UAE its very common for people to overstay on a visit visa etc. It usually ends up badly with them being deported but they don't care since they're not going to build a future in the UAE anyways and the exchange rate is good.

I meant that lots of people violate immigration laws and overstay visas or don't follow the conditions of their visa. In the UAE we had this happening on a large scale where people were coming on visit visas and not going back after the visa is expired.

Generally overstaying visas and not abiding by the terms of visa are not heavily enforced which is why the person who started the conversation has not got any notice.

Even though it is not heavily enforced that doesn't reduce the seriousness of the offence.

Having been brought up in the UAE I have seen such issues up close. Unlike Canada the UAE does not give PR or Citizenship so people work illegally till they get deported.

Sorry, but I think the issue is about if the OP is inadmissible because of excess working hours...

Yes you're right , I was just making a general statement about overstaying visas and not following the visa rules. It's generally not enforced a lot. Places like Australia are cracking down on it though.

So far, no IRCC agent has contacted me so I’m desisting from working any further. I’m going back to school in January but I don’t have much trust in pgwp. My pr application is underway as I have a pretty good score. My only prayer now is to go through express entry and survive.

Yes PGWP is not 100% garunteed. Keep looking at the positives and go forward. Good luck.

So 100% both CRA and IRCC know that you have violated your study permit. I highly, highly suggest that you go do an Immigration lawyer ASAP and get a consultation and see what can be done. They should be knowing if any precedent has taken place that can help your case. Do note that none of us in this forum are lawyers and information given here is not legal advice.

To my knowledge, a student is allowed to work only 20 hours a week off campus under study permit. You cannot work off or on campus if you are a part-time student. The only exception to this is when it is your final semester of college where you can be a part-time student and continue to work as your study permit allows and be eligible for PGWP.

Since you said that you have worked more than 20 hours you have basically violated the study permit regardless of being a full time student or a part-time student. Thus any future visa requests or PR applications will have this on record. As on date these are the facts.

You need to go and get a lawyer and see if there is a way to squeeze out of this problem, I wish you the best of luck.
CRA doesn't know or give a damn how many hours OP is allowed to work. They don't really care if people work illegally as long as they pay their taxes and they do not share information with IRCC unless there is legal action being taken.

IRCC doesn't really have any way of knowing a student is working illegally unless someone reports it to them. A ridiculous amount of students get away with this because there really is no other way.

A lawyer can't do anything. All OP can do is be honest about the illegal work in future applications.

No one will contact you from IRCC. You maybe caught out during pgwp application. As to EE I am not sure if this violation may have any bearing on getting an ITA.

So does the IRS and I am sure pretty much every tax agency makes or sure that they get their cut. I believe the IRS has a line in their tax form that tells you to put any income that you made illegally and I know for a fact that the Indian tax return forms has a place for "undeclared income" ( you are taxed 60% though ).

Ironically if you are working under the table you are more likely to have someone rat you out.
