All,

I am about to submit my application today, I came across Statutory Questions and bit confused what to answer.

My situation: I am in US on F1 visa, and last year my H1B visa application (not stamping) was denied due to in sufficient documentation. what I need to answer for below question (Yes or NO)

1. Has <Name> been refused refugee status, or an immigrant or permanent resident visa (including a Certificat de sélection du Québec (CSQ) or application to the Provincial nominee Program) or visitor or temporary resident visa, to Canada or any other country?

2. Has <Name> ever been refused a visa or permit, denied entry or ordered to leave Canada or any other country?:

Any feedback will be appreciated.

your petition was denied not the visa, but you should mention it since it was picked up in the lottery.
If it would not have been picked up in the lottery then u should have said no.

Generally, the petition is linked with the petitioner which is the employer in this case. Just to be in the safer side u can say yes.
Wait for few more comment's.

Thanks for your replay. I need to say YES to both the questions or just for 1st one?

It's NO on the first one.
Second one is trickier as h1b can be considered work permit. But there is a guy @sid1987 who answered NO and got his PR. Check with him.

Second one is trickier as h1b can be considered work permit. But there is a guy @sid1987 who answered NO and got his PR. Check with him.
yup... I said no..because petition is not visa... plus work permit has very ambiguous line...so its ur call.. but I had answered no... so tech both works

Thanks Sid and Navinball. If I say "YES" for the second question, is it negatively impact any in my application.

i was refused Canadian visitor visa, 2 years back. so should i say yes to both questions? and should i list all the things due to which my visa was rejected as listed in the rejection letter since they ask for details?
