Hi. Me and my husband have been living in Canada for about 2 years and a half. Our daughter is a Canadian citizen, she's 2... Our visa expired after 6 months we came, but we decided to stay cause i have close family here. My parents and a uncle/aunt (documented) Unfortunately, My daughter was diagnosed with autism... I wonder, if that would be enough to appeal to h&p... Since she's a Canadian citizen... I'm afraid they would just send us away and we have nothing back to our country and resources about autism are not good... Not sure what to do. Thank you

Hi, tbh your situation is very different. Its better to get advice from an immigration Lawyer.

So you violated the conditions of your original visa and overstayed for two extra years?

Since you are in Canada without status, your only option for applying for PR from within Canada. would be to apply under H&C. Approval rates under H&C are low and applications typically take around 2 years to process.
 
Very risky.. one thing that's very clear in Western world is that they just don't let parents use anchor babies to get any kind of immigration benefits. why do you want to flip back to legal status now? If they deny your application, they'll deport you along with your baby even though the baby is a Canadian citizen.
