Hi

I am planning to sponsor my mom(widow). I have sister, age 28, disabled(polio). She is mentally fit. My sister is dependent on my mom for everyday work.

Now, If I sponsor my mom, my understanding is my sister will also be included in it. Is it true? does the application forms for sponsoring parents has a option to add dependents of parents?

Is there anyone in the same situation?

Any help appreciated.

Yes a daughter who is totally dependent on parent due to a medical condition, can be considered as a dependent no matter what age they are.

However there is a very good chance she would fail the excessive demand portion of the medical exam due to expensive care/treatments required after becoming a PR, causing your mom to also be rejected.

Also I assume you know the parents program is already closed for this year. If future years you'll need to enter a lottery to sponsor parents if you meet the 3-years of Canadian income requirements, and hope you're picked.

Polio can cause a range of disabilities, from mild to severe. What are your sister's disabilities?

Including a disabled child is bit of a catch-22. The child must be disabled enough to be considered dependent but not so disabled as to exceed the Excessive Demand Threshold.

I really wouldn't worry about it right now. If you just landed in Jan 2016, then with Canadian income meeting minimum LICO for parents in 2016, 2017 and 2018, you can only think about applying to sponsor your mom in January 2020. And it may even be many many years after that depending how they are selecting people to apply.

So wait for a few more years, see what the rules are at that time, and what you can possibly do to include your dependent sister in the app.
 
i will be applying in 2019... i meet canadian income requirement for 2015, 2016 and will meet for 2017 too...I got my residency in Jan 2016.. was on work permit before..

IRCC has never introduced any rules regarding dependent sibling..My sister has no other problem, the only thing is she can't walk..

I am hoping to find someone in the forum who has a success in such kind of case

I suggest you research medical inadmissibility and procedural fairness for paralysis.

What do you mean by "rules"? There have always been rules around adults being allowed as dependent of their parents due to a disability, and there have always been rules around medical excessive demand.

If your sister can be self-sufficient i.e. if she can get a job on her own... then they may not see her as a dependent.

If they do allow her as a dependent, then the excessive demand rules may apply. You can read about these rules here: http://www.cic.gc.ca/english/resources/tools/medic/admiss/excessive.asp

Also small correction, you "may" be applying in 2019. Of course you'll need to win a lottery spot first just to be invited to submit a parents application.

It is possible you will be able to sponsor your mother and your sister. People have succeeded in spite of a disability or illness. The visa officer looks at the likely cost to the Canadian government per year if the person with a disability is allowed to immigrate. People often write up a plan showing how they will deal with the disability without using an excessive amount of government services.

I want to ask question for my friend. She is Canadian Citizen and her spouse is PR.
She meets the income requirement for last 3-4 years.
She wants to sponsor her mother and her brother who is adult but disabled and dependant on her mother.
How she should proceed? Any insights on this matter will be appreciated.

First your friend should be really doing the research. The new sponsorship rules will come out at then end of the year for 2019 sponsorship. The fact the her brother is disabled will likely be a huge issue. Any medical costs will be factored in plus the cost if the family is no longer able to care for him at home. There is a 20 year wait list for group homes for most disabled adults and the cost of care is very high so you will have to convince the government that he won't be a burden to the taxpayer. It is very difficult to overcome this challenge but you can always try and see what the outcome will be.
