May 2018 Outland - Do we have the high chance to interview?

First of all, we are the same sex marriage.
I and my spouse was met on Sep 2013 and our relationship started.
Feb 2014, I moved to his place and living together with his landlords who are senior couples and know our relationship and did affidavit for us.
Our relationship grew and on Jan 2016 we married in toronto. However, I found out he still has some connection with his ex, so we are separated since 2016 Feb. And Nov 2016, I immigrate by express entry as a leggaly seperated status.
But the thing is, he got the voluntary departure order on Mar 2017 due to his refusal on H&C application, and left on time. When he left canada, he told me that he was overstayed in Canada since 2006.However during our separation, he was trying to fix our relationship and I found that I still have feeling on him, I want to sponsor him back to toronto so we reconcile on the first trip I back to visit him which is Mar 2017.

Our backgroud check has been processed over 1 month and haven't received pre-arrival letter.Is that normal?
Do we have the high chance to get interview? I heard from other forum said that they won't process the backgroud check only if the vo think your relationship is genuine.
Should I order the GCMS note?
I have my lawyer and he said it was not necessary to order it. Just want to get some info and advice here. Thanks

Your application has been in process for three months. The targeted goal for processing is 12 months. Background check is the longest part of the process.

As to whether or not they will interview you, that's hard for any of us to say. Ordering the GCMS notes will give you some information about your application and how it is being processed.

Yes, there is a higher chance of an interview. There are many big red flags: 11 years living in Canada illegally, refused H&C app, deportation, break in the relationship at a fairly convenient time for your PR app.

My lawyer told me if that time we didn't broken, I bring him with me in my pr application which can be approved because he was not inadmissible that time.

Thanks Canuck. Another question is if they do have these concerns they will have the interview before they processed background check right? Cause I find the timeline for other interview case, most background check was processed after interview. And they said they only process the background check after vo think your relationship is genuine. Thanks

An interview can be called at any point in the process.

Thanks. Do u agree my lawyer’s point? Cause when I apply my or, my spouse haven’t received departure order. My lawyer said if that time we were not seperate, my spouse just came back to his country and as an accompany family member then his pr can be settled.
When I apply the sponsor for my spouse, I was worried about the point you said about convenience of seperation, but my lawyer told me so. He said if you were fake marriage only for the pr, then the best chance was to add him in your pr application. Then both of your pr can be approved. And I asked not only 1 lawyer, they all indicated that point.

Regardless of the circumstances, it is always a red flag when a couple splits, one becomes a PR and then they reconcile.
