Hey guys,
I have the following queries pertaining my ee application -
1) I received ITA on my last day of work experience - I am working as a solo practitioner at law and got enrolled in the bar on 16th OCT 2017. My full one year experience gets completed on 15th OCT, 2018. I received ITA on 15th October 2018, What should I do? Decline or accept? as it is on the last day of my work experience.
2) I created my profile on 10th Oct, 2018. I didn't have 1 year work experience by then, but the ee wizard calculated it as 1 year and put me in the pool. Will it count to misrepresentation if my profile was submitted without me having an year's experience?

Perhaps yes. I read somewhere else that the lock-in date is when you submit your EE profile. I am exactly in the same boat as you, exact same dates for work experience. However, I submitted my profile only after the end of the working day (15 Oct 2018), thus technically completing 1 y. I got my ITA yesterday, planning to go ahead and apply

If your lock-in date is EE submission, then better to decline and then wait for the next draw

Technically, if one doesn't have 1 y work experience, they do not even qualify for EE

Well, when I created my profile and was asked about my experience in questionnaire before actual profile submission, I entered less than one year; and it showed I was ineligible. But when I continued with my profile and entered the month and year in my work history section, It showed my cars and assessed me as eligible.

Yes, I don't think one is allowed to continue creating a profile if the system says ineligible in the first place

I directly logged in from GC Key. I filled the questionnaire and it said ineligible. I went to my profile and there was a section for continuing the pending applications. I continued with my ee profile then. My situation is very different, I think I better reject it because I don't wanna create a doubt in the officer's mind. And you can not say, if they will take the last date of your work when counting your experience; because work experience section says 12 months, and technically 12 months have not been completed on 15th October.

I see what you did. If its your current job, I don't see any reason why they wouldn't consider your last working day. In my case, my official working day was already over and hence I proceeded to submit my application. Timezone differences.

If you include 15 Oct in your calculation (which you should), then technically 12 mo is over

You never know with these immigration officers. It really boils down to their discretion. What is your mrs anyways? I am at 453.

It all depends on how you pitch your case. Mine is 468

I don't think it is a big deal. However, you have 453 and you will definitely be invited on the next round. So just decline it and Wait for the next one to avoid months of stress while you are asking your self whether the officer will accept it or not.

What would you recommend doing? Going ahead or declining it.
It's 50-50 really. Based on your profile submission date, I would suggest declining it. Just ask yourself whether you represented facts clearly while submitting your profile, having known that a minimum of 1 year is required as work experience

You are probably right.
