Express Entry Application: Job Offer/ Work Permit/ LMIA related Queries

Hey Guys,

Hoping someone can help me figure this out. I am filling up my express entry application and I have a few questions:
1. Do I get to choose whether I need to apply under CEC or FSW or is it auto-generated once I complete and submit my profile?
2. for the question Does the Applicant have a job offer in Canada? - I am on an open work permit and have been working for over a year Full time in Canada. But I don't have LMIA. Should I select Yes or No? Also, in case no, then for all the subsequent related questions I have to select no too?
3. Under Intended work in Canada section - I came across a couple of questions, I am not sure about:
a) After saying yes to do I have a valid work permit for current job in Canada -the next question is, Is Your job offer from the employer named on the current work permit?- I have a 3-year Postgraduate Open work permit - so should I select yes or no for this??
b) Four-digit NOC code of current work permit? - Since I have an open work permit there is no NOC Code - So should I just use the NOC code of my current job?
c) Was a positive Labour Market Impact Assessment (LMIA) issued for the current work permit? - Again since I have an Open Work Permit after doing my Graduation from Canada - What should I select here? Options are as below:
1.Yes
2. No
3. No - My work permit is exempt from an LMIA due to an international agreement.
4. No - My work permit is exempt from an LMIA due to Federal-Provincial Agreement.
5. No - My work permit is exempt from an LMIA for other reasons and is employee specific?

1/ No you don't choose. If you're eligible for both CEC and FSW; you'll be invited through the CEC first. Note: If you decline the invitation, the system will not re-invite you under the next program. You will go back in the pool, and if you're invited again, the same order will apply.

a. Because it's an open work permit, no employer will be mentioned, so "NO". If it was "YES", that would make it a closed work permit.

b.Yes. Use NOC of your current job.

c.Well basically, because it's an open work permit, you didn't need to get a LMIA. So I'm safely assuming you didn't get one. If you did, you would know about it as it requires going through some obstacles. The answer is "No". None of the options 3/4/5 apply to you.

Thanks for your prompt response Peacekeeper - much appreciated! Just a follow-up question on Job Offer? If I choose that I don't have a job offer - don't you think so it'll contradict subsequent responses in that section such as Have I worked in Canada for at least one year? and the name of the employer I worked for etc.? Also, under work history, I am primarily showing my Canadian Experience. The point I am making is if my job offer is not valid then how can I score points for my Canadian work experience and make that experience count to get qualified for CEC?

I would also request senior members to step in and share their two cents.

You are absolutely right. Your questions are specific. To avoid sending you in the wrong direction, I'll let more senior and experienced members bring their advice.

Yours is a PGWP which is a OWP hence the answer should be No.
