my wife and i had a son, but me and my wife decided not to put my name in my son's birth certificate since we are not yet married and they are in the middle of becoming PR in canada that time. My wife was so afraid that our son could not go with them in canada so we went to that route.

now she is planning on sponsoring me to canada, and in the application, there is a question that says "do we have a child". if yes, attach birth certificate with my name on it.

we are unsure on how to answer it, any suggestion on how to deal with that case would be much appreciated.

The question is simple. Do you have a child? The answer is YES. Why would you think to answer any other way?

You provide the birth certificate for the child and a statement explaining that you decided together as a couple not to add your name to the birth certificate.

It's not rocket science! And I really don't understand how people ask these questions. Do you have a child? Yes.

It will not be a problems at all . He can change his last name at the age 18. Visa will be issued as it is

His parents can change his name now if they want to. Why wait until he's 18?

YES it is : change now or at the age 18. I saw it happened to a friend who married a woman with her perv kid. BUT she can give father's last name to son right now. Go >make Aadhar card 1st then >PPT with name change . I hope she had a a last name on DOB certificate if not even then there are ways to do that. Which I can tell for example: Dr's certificate where kid was born, affidavit and so on

Agreed with above advice. And if CIC requests you to do a DNA test to approve the kid is yours, then just do it, simple as that.

I had the same dilemma when I sponsored my husband last year. If I can still remember, my husband answered yes, and then I provided my sworn statement that my husband is the father of my son and had it notarized. We've also included it on our love story and explained what happened during that time. My husband is here now and we are working on adding his info on our son's birth cert. FYI, you can change your son's last name anytime but if you want to add your name on your son's birth cert you need to provide a court order.

Hope this helps. :)

Something doesn't make sense. How did your gf get PR? Have you been living together for a year in your home country? Why did she not include you in her application?

her mom already applied for application and took them 7 years to be approved. no we are not living together. she did not include for the reason that they will be delayed once more and we are not yet married that time.

She would not have qualified had you been married of common law. When she goes to sponsor you there will definitely be concern that you have been living together since before or after your child was born so hopefully you have lots of proof of your separate addresses.

If she was married or common law she would not have qualified for sponsorship through her mother. In order to sponsor you you'll have to prove that you have never lived together for 1 year or more. If so, she also couldn't sponsor you.
