This seems new as I don’t recall this line of question.

To explain better, the part where the spouse fills personal history, there is a part where you have to fill info of all your relatives... mom, dad , etc.
For my spouse, her sister is in the US on a study visa which expired I think August but she is still in th US.
So while filling hers, there is a question- country of residence (where she must be residing legally).
My spouse isn’t sure what country to put without misrepresenting because honestly, she is in the US.
Leaving her out is omission as such, misrepresentation

When did she complete her studies in the US? Do a screen capture of that page and post here. I don't believe they care about the immigration status of the sibling of any applicant. Remember you have no control over what your sibling does with their life.

She didn’t even go through with school, she doesn’t really say much about the developments over there. But the Visa was till August....
You mean the screen shot of the question on the application page?
If yes, I dont have access to my laptop right now .... however the question is simply;
Country of residence?
I took a screenshot of the pop up when I click on the question mark

Don’t know how to post it here

When did she complete her studies in the US? International students have a 60 grace period to depart the US after completion of studies. Do a screen capture of that page and post here. Although you will have to disclose where her sister lives, I really don't CIC will really care about her immigration status.
If it was you or your spouse, that's a different story.

Even if it was 20 years, I don't think it would pose any problem to you or your spouse. Not the kind of thing CIC is looking for...
It would have been a different story if it was you, the PA.
Just be 10000% honest and say that she's living in the U.S.

All this time I thought you were the one who were there illegally... XD
