Recently I completed 1 yr of work exp. My noc 6231 insurance agent and I came to know that I am an independent contractor with that company but working full time and my roles are as per noc 6231. So what do you suggest now how do I file my application.

The company gave me basic salary plus commissions on my sales for first 3 months but after that company stopped my salary because I was not able to acheive my target and for last 9 months I was paid only commissions on my sales.

The company will provide me a basic experience letter which will disclose my joining date and designation and my manager is willing to sign detail experience letter as per IRCC requirements.

And to justify my income I can provide tax certificate and salary and commission credited in my account.

Will it suffice for fswp and what to do with that contractor thing.

Further is that this type of contract is given by the company to me at the time of appointment that I have signed please review and help

LOL, it would help if you specify that the work experience was foreign (not in Canada). Self-employment is permitted for foreign work experience, but not for Canadian work experience. Your documentation sounds like it should be sufficient.

Sir so what should I do I can get simple exp letter from my company and ircc format exp letter from my manager. And can provide tax certificate bank statement of commission credit etc.

Company provided me contract of hiring my services to sell its products. So what should I do I dont consider my self as self employed as in contract it is mentioned that company will compensate me for my services.

Read the proof of work experience section, there is a paragraph on "self-employed."

Sir so what should I apply under as self employed or as generally employed because in my contract if you read it is written that

The specified person contacted us to offer its services and after consideration we are desirerous to appoint him as our insurance agent to sale our products.

Please read that on this link and guide me what should I select.

You don't "apply under" either one. But for that particular job I would indicate that you were "self employed."

I am not dismissing your points, it is actually quite a hot topic in Canada with significant tax implications (which is why it is a hot topic). There is an argument that there is a third category between "employee" and "independent contractor" - called the "dependent contractor" who is contractually self-employed but in terms of how the work is carried out, is more like an employee and only have the one "client/employer". Insurance agents are a key example. Google it if you are interested.

But none of this really matters for your application. Either your "employer" claims you as an employee, or they claim you worked under contract, and you provide the extra documentation that you already have. It is not a problem :)

Thanks for your reply

So as I understood I should select my noc as 6231 and provide my exp letters and income and tax proofs and let Ircc decide that i am self employed or not. And in either way it is not a problem for me as long as I provide exp letter and the proof of commissions I got from it?

Should be, as long as you provide the required details. My only concern is whether you can prove you worked full-time or not...

Hi, did this work in your favour?
