Chance to get PRTD

Hi,

My dad is outside Canada now and his PR card is expired, also he was outside Canada most of the time in the past 5 years which means he didn't meet the residency obligation. Is there any chance he still get a PRTD to come back to Canada then fulfill the residency obligation and renew PR card again?

Use the forum search for humanitarian and compassionate grounds to get an idea of the possibilities.

The TL;DR is: Unless your dad had a very (!) good reason to stay outside Canada, it is unlikely that a PRTD application will be accepted.

As spyfy said, it depends on the reason why he's away for so long.

There are cases on the CanLII website where the appellants spent zero day within the past five years, and still won the H&C case, so it's definitely possible, but it's very hard, in the vast vast vast majority of cases, it would not work.

Simple illness of parents of relatives, work, education, wedding, pregnancy would not be accepted. The reason needs to be extremely compelling.

Taking care of ill parents is one of the few reasons that IRCC will accept (not always but there is a decent chance). But they have to be really really ill (bed ridden, on their deathbed, etc), with no one else around to help. Agree about the other excuses though.

Yeah, true. I did mention 'simple' illness :) And you did mention a good point, there must be absolutely nobody else around to take care of them.

What a lot of people seem to use as an excuse is something that goes along the line: I cannot live in Canada and must work in the Middle East to take care of my sick mom who lives in India. That won't work.

Is it ok to send more supporting documents to canadian visa center by email? Few days ago,i received an email from visa center in dar es salam, requesting my rental and school record when i was living in canada. I sent them right away to the same enquiry email address . Is it ok?

Follow the instructions in the letter. It should specify how they expect you to submit the documents.

"Factors we look at include:

  • how settled the person is in Canada
  • general family ties to Canada
  • the best interests of any children involved, and
  • what could happen to you if we do not grant the request. "
So My dad is the only one outside of Canada now, Me and my siblings also my mother are all in Canada. Is it likely they will approve it?

No they will likely refuse it especially if he was working. Just an FYI but hopefully your family was declaring his income because he was a resident for tax purposes. Your mother can just sponsor him again once he renounces his PR.

Hi,

Thanks for your reply. My dad is not working, but he does file tax every year.....My parents are in retirement age now, I know there is no income requirement for spouse sponsorship but we still need to prove my mom can support my dad and they will not need government support, so I was hoping he can keep his PR status and we don't need to reapply.
