Hi everyone,

I am very confused with my working hours. I have been working for 2 years, and I am going to quit my job this month.

I met an immigrant consultant, and he told me that my working hours are insufficient. When I devided my total working time into total working weeks (104weeks), it is about 35 hours (my company had 2 week vacation (one week for summer and winter, respectively) a year-all staff should take vacations as well because the company closes its business for the period of time)

However, the consultant said that it has to be 30hours/week. No matter how many hours I worked for any other weeks. That means that I have to fill up all the missing weeks (total 6weeks which I missed some hours for several weeks some are 28 some are 29.5, including my sick leave(unpaid))

Can 4% vacation fees cover up the vacation days? The amount of money is more than enough to cover up all the vacations according to my calculation.

I am so confused because my fridnds all got PR without any concern about the exact hours per week.

It's a minimum of 30 hours a week. If vacation weeks are paid they don't count
What was your week schedule like? Didn't you have fixrd schedule? What was it like?

The schedule was depending on patients. If they cancel the apointment, I have to finish my work for the day. :(

Count those 2 vacation weeks as full-time employment.

However, the consultant said that it has to be 30hours/week. No matter how many hours I worked for any other weeks. That means that I have to fill up all the missing weeks (total 6weeks which I missed some hours for several weeks some are 28 some are 29.5, including my sick leave(unpaid))

Just add up all the hours you are short, it doesn't sound like that many. You might need to work an extra week just to cover the time, but it's not a big deal.

You stated that you took 2 weeks of vacation. So, no, you cannot count more vacation time (4% is the equivalent of 2 weeks).

Maybe their situation is different - it is easier for salaried workers than hourly wage workers - maybe they got lucky, but your consultant is technically correct. It is possible if your letter of employment says you work "an average of 35 hours per week" and your annual earnings match reasonably closely, that IRCC would approve it. But for hourly workers, they often ask for paystubs and such that could reveal the time missed...

In any case, I always suggest that people not to cut it too close - one year is the MINIMUM, work a few extra weeks to give yourself a cushion to ensure that you are covered in case of the VO calculates your time differently...

What was your job anyways? So you work per hour? On whay basis do you get paid?
