Marrying a Canadian / sponsorship advice

Hello, wondering if anyone can help.

I’m in Canada at the moment and I plan to marry my GF in the next 4-5 weeks and then apply for a work permit, sponsorship, PR card etc. From what I understand the work permit can take up to 4 months, and the sponsorship and PR up to 12. (Although I get to remain in the country on an extended Visitor Visa which expires in mid Oct)

In an ideal world I really need to return to the UK for a hospital appointment at the end of the year, and I require daily medication I need to bring back with me to Canada.

Obviously without health care in Canada this is a major issue for me and without it I wouldn’t take more than a few days to get sick which would affect my performance at work.

So I’m wondering if there’s any chance I could leave the country in October/November having applied for an extended Vistor Visa and work permit while in Canada.

Return to the UK, then apply for PR card and sponsorship (which I believe is quicker with an Outland application in the UK), then return without them on the visiting Visa I have had extended when I have a work permit?

Is this possible or far too risky?

I would return back 1st. Then get full treatment,then ask a Canadian Medical Dr. if your existing condition is not an obstacle for Canadian Visa.
Then apply for a visitor Visa again ; which surely you will get. And then you will have enough time to decide further. Good Luck!

Oh jeez I had no idea about the medical and just read up on this.

Seeing as it’s Crohn’s disease then it looks like I’m at risk of inadmissibility too.

As per paragraphs R24, R117(g) and R139(4), excessive demand determinations under A38(1)(c) do not apply to:

• spouse, common-law partner or conjugal partner
• a dependent child (including an adopted a child) of the sponsor, or of the sponsor’s spouse, common-law partner or conjugal partner;
• Convention Refugees;
• protected persons.

Although such individuals must undertake a full immigration medical examination, they are not assessed for excessive demand.

You can only apply for the owp if you apply inland. Inland means you have to basically live in Canada with your partner through the process, people say it’s ok to take a trip away up to 2-3 weeks during the process but the risk is gaining re entry.

There is no OWP with outland. You need to apply inland to get the OWP. Given your need to return to the UK and the potential for health complications, I would strongly suggest you apply outland.

You will have to return to the UK every 90 days because you can only bring that much medication with you. Also doubt that the NHS is going hand out a year of I'm guessing biological medications given the cost. I also hope you or your gf has a job with extended health benefits. Think you may have to go outland which mean you go home or you stay in Canada but can't work.

Visitor status ends when you leave Canada. If you are approved for an extension and then leave, that status is done and does not give you any right to re-enter. You will be evaluated as a new visitor upon re-entry.

You can submit an outland app while you are in the UK. As said above, the visitor extension is not relevant for re-entry.

No. As already stated by a few people, the OWP only applies to inland apps. You would only be a visitor until the outland PR app is approved.

Not sure what you mean. You will need to keep your address updated and your COPR will be sent to that address.

No, you cannot get a work permit in Canada if you choose to send in an outland application. In order to get the work permit, you will have to be in Canada and apply in Canada. You can leave for short trips, but should be living in Canada with the Sponsor.

Extended Health care through employers is not the same as regular health care. Extended health care covers things beyond what regular health care covers, things like dentist, massage, physio, psychologist etc. Finding a job that gives you extended health care might help with medication costs (I am not sure how that would work, specifically, and it depends on each plan), but it will not cover exams associated with your condition!

Hmm, I've left Canada twice since April (albeit for 3 days to USA)...and this has not been an issue.

I had spoken with somebody to today at Govt office who suggested a multiple entry visiting visa as opposed to single entry but was hazy on the details.

I'm not sure which I currently have (if there even is such a thing) so it seems like I've definitely been riding my luck leaving and coming back already on those trips.

So to be clear I had hoped to apply for the extended visiting Visa > apply for the OWP while in Canada > Go to England, bring back medication and apply for the PR and sponsorship there > Come back to Canada on the existing visiting visa on this suggested Multiple entry one > Use my OWP that I would receive when I get back to Canada > Have the PR and Sponsorship delivered to the UK and then delivered to me.

But by the sounds of it, there's little chance of me achieving this and I could find myself stuck in England without my wife and refused re-entry to Canada, or i stay in Canada without medication and healthcare, which is very likely I will get too sick to even work.

Both are awful scenarios!
