You should restore your status as visitor first. In the meantime put together your PR application and a OWP application together in one envelope. But in order to be approved for a OWP, you must have valid status so restore your status as a visitor before mailing off your applications.Hi Wonderland_1010,

My work permit (IEC) expired in 05-April-2018 but I applied for work permit extension before it expired.
Recently, I received refusal letter from IRCC and my latest temporary resident is 18-July-2018.
Now I losing status in Canada about a month.
I just got married on 18-Aug-2018 and my husband is Canadian Citizenship.
We are going to apply Inland Family Class Sponsorship but before that we believe restore my status is needed.
I'm wondering should I apply restoration as worker or visitor is better? By the way, I don't have LMIA.
I would like to have my work permit back asap as I know Inland Family Class Sponsorship is going to takes up to 12 month to process.
Hope you can give me some advise, me and my husband would be grateful and take it as consideration.

Like you said, I couldn't apply OWP until I have visitor status. Not sure is there anyway can request IRCC for a speedup process?
Based on the CIC web, the processing time is 70 days for visitor extension (it is based on working on applications received on June 2, 2018).
Wait for the processing is complete that I might be already overstay and have to leave Canada immediately?
Is that possible to apply Inland Family Class Sponsorship while still waiting updates for my restoration as visitor?
And once I have the visitor status then apply for OWP?

Ottawa, December 15, 2017 – Family reunification is a key immigration priority for the Government of Canada. We recognize that when families can live and work together, their integration outcomes are improved.
That is why the Government of Canada is extending the open work permit pilot for spouses and common-law partners applying for permanent residence under the spouse or common-law partner in Canada (SCLPC) class until January 31, 2019. This ensures applicants are able to work, provide for their families and contribute to the Canadian economy while waiting for their applications to be processed.
To be eligible for an open work permit, you must be a spouse or common-law partner living in Canada who is being sponsored under the SCLPC class. You must have valid temporary resident status (as a visitor, student, or worker) and live at the same address as your sponsor.
If you have already submitted an application for permanent residence but have not yet received approval in principle under the SCLPC class, or have not yet applied for an open work permit, you can complete the work permit application. Send your completed application, along with appropriate fee, to the Case Processing Centre in Vegreville at:

So this call agent advised you to apply for OWP and Family Sponsorship within 90 days? I don't think you would be eligible for a OWP since you don't have valid status.Thank you so much for the information. Appreciate it.
FYI, I have some information from IRCC which I just had a call with one of the agent.
In my case, the agent suggest I straight away apply for Restoration as Worker and Inland Family Sponsorship at the same time.
It might speed up instead of restore as visitor --> once get visitor status --> apply OWP + Family Sponsorship.
I would need to submit Restoration as Worker + Family Sponsorship within 90 days from my temporary resident expired date 18-July-2018.
But in my case, IRCC wouldn't consider me as "implied status" even I submitted both papers because I already under "out of status".
But I can call them within 90 days from 18-July-2018 to check what is the processing status for my application.
They may take it as an exception once my application reach to the certain stage.
Anyway, finger cross for my case and hopefully I don't need to leave Canada or apart from my husband.
Would probably better to consult more forum posters like @scylla. But i still think you would need valid status before you can apply for OWP.Yes, the agent think that is the better way. I was keep reconfirm with her because based on what IRCC website mention valid status is mandatory for OWP. But she said it works for my case but I need to apply Restoration as Worker + Family Sponsorship at the same time. Maybe I should make another call tomorrow to check what other agent say.

Hi, don't worry he will be given the work permit but the processing time is like 3 months . yeap they treat it like a new application . Also i send the 3 copies of my payslips as additional evidence . you can submit via the web forms. Don't lose hope things will work out. Mine is very similar to your situation. I applied for open wp extension for myself and for my husband. Mine got approved for three years but unfortunately my husband's wp got rejected on Jan 14th saying that I haven't provided employment letter with NOC. His status was also expired on the same day ie Jan 14th,2019.
Now I have reapplied on Jan 30th with my employe letter with NOC code B and also have paid restoration fee to restore his status. My hubby has applied for long leave for 2 months as he cannot work and now he is in situation of loosing his job as the processing time is very high.
It would be really grateful if you can tell me how long does it took to get it approved and also I am very worried of facing another rejection. Totally clueless. Sharing your experience does really helps. Thank you.
